RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2005-00905
XXXXXXX COUNSEL: NONE
XXXXXXX HEARING DESIRED: NO
MANDATORY CASE COMPLETION DATE: 16 SEPT 2006
_________________________________________________________________
APPLICANT REQUESTS THAT:
Fifteen days of leave be restored.
_________________________________________________________________
APPLICANT CONTENDS THAT:
Due to mission requirements and no fault of her own, she requested 15 days
of leave be reimbursed to her leave account. Member has exhausted all means
of getting her 15 days of leave reimbursed to her leave account. Case
management system print out, SLA letter, leave and earning statement (LES),
permanent change of station (PCS) orders and retraining approval package
are attached to support her case.
In support of the appeal, applicant submits a letter of support from her
commander, LES, PCS orders, a retraining package and a case management
print out.
Applicant's complete submission, with attachments, is attached at Exhibit
A.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of senior
airman.
The applicant lost five days of leave at the end of FY 04. She carried
forward 45 days of leave at the end of FY03. She used 10 days of leaving
during FY 04. The applicant did retrain and PCS enroute to Lackland AFB,
TX during FY 04.
_________________________________________________________________
AIR FORCE EVALUATION:
AFPC/DPFF recommends restoring only 5 days of leave.
_________________________________________________________________
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 15
April 2005 for review and response within 30 days. As of this date, this
office has received no response.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error warranting some corrective action. The applicant
contends that because she was attending technical training from 27 Oct 04
through 28 Oct 04, she was unable to take leave during this period and as a
result, she lost 15 days of leave at the end of the fiscal year. She
requests that 15 days of leave be restored to her leave account. However,
the Air Force has indicated that she was authorized to carry forward 45
days of leave at the end of FY03, used 10 days during FY04, and therefore,
she only lost 5 days of leave at the end of FY04. We have received no
evidence from the applicant refuting the Air Force's evaluation.
Therefore, it appears that the appropriate corrective action to be taken in
this case would be to partially approve her request by restoring 5 days of
leave to her leave account. Accordingly, we recommend her records be
corrected as indicated below.
_________________________________________________________________
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that five (5) days of annual leave were
added to her leave account commencing 2 October 2004.

Applicant requests 60 days of leave be restored to his leave account and he be entitled to sell his leave upon his 1 May 2005 retirement. The Air Force has recommended restoring 60 days to the applicant’s leave account. In reviewing the applicant’s MMPA, DFAS determined, however, that the applicant’s account should have reflected 26.5 days of leave at the time of his retirement.

His commander received an informal email in late November 2002 requesting that an Officer Performance Report (OPR) be prepared for the February 2003 major board. Since he is no longer a member of the Air Force Reserve as a result of the two nonselections, he is not eligible for consideration by a Reserve promotion board. All of the officers selected for promotion by the FY03 board had completed SOS and 94% of the officers selected by the FY04 board had completed SOS.
