APPLICANT REQUESTS THAT:
His record be corrected to show he was awarded the Vietnam Service
Medal (VSM).

APPLICANT CONTENDS THAT:
He was TDY to Thailand from 12 August 1973 to 29 January 1974.
In support of his request, the applicant submits AF Form 626, Request
and Authorization for Temporary Duty-Military, AF Form 2095,
Assignment/Personnel Action, DD Form 214, Report of Separation from
Active Duty, and a copy of Report on Individual.
Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force as an airman basic on
9 March 1971, for a period of four years.
His record reflects that he performed temporary duty at Karat RTAFB,
Thailand from 12 Aug 1973 to 29 January 1974.
On 8 November 1976, he was discharged with an Honorable Discharge in
the grade of staff sergeant after completion of required service. He
had five years and eight months of total active service.
His DD Form 214 reflects award of the National Defense Service Medal
and the Good Conduct Medal.

AIR FORCE EVALUATION:
AFPC/DPPPRA recommends denial. The VSM is awarded to all service
members of the Armed Forces who between 4 July 1965 and 28 March 1973,
served in the following areas of Southeast Asia: In Vietnam and the
contiguous waters and airspace, in Thailand, Laos, or Cambodia or the
airspace there over or in the direct support or military operations in
Vietnam.
The AF Form 626 authorized the temporary duty to Thailand, but not
until August 1973. The close out date of eligibility for the VSM was
March 1973.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 4
Feb 2005 for review and comment within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After a thorough review of the
available evidence and the applicant’s complete submission, the Board
is not persuaded that he is entitled to the award of the Vietnam
Service Medal. The Board agrees with the opinion and recommendation
of the Air Force office of primary responsibility and adopts it
s rationale as the basis for their
conclusion that the applicant has not been the victim of an error or
injustice. Therefore, in the absence of evidence to the contrary, the
Board finds no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
