APPLICANT REQUESTS THAT:
He be considered for promotion to the grade of lieutenant colonel by
the Fiscal Year 2005 (FY05) Line and Nonline Lieutenant Colonel
Position Vacancy (PV) Selection Board.

APPLICANT CONTENDS THAT:
Due to an administrative error, his Promotion Recommendation Form
(PRF) was not received for consideration by the FY05 board.
In support of his appeal, the applicant provided a copy of his FY05
PRF, supportive statement, and other documents associated with the
matter under review.

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) indicates
that the applicant is currently serving in the Air Force Reserve in
the grade of major, having been promoted to that grade on 1 Oct 98.
He is credited with 16 years, 3 months, and 1 day of satisfactory
Federal service for retirement.

AIR FORCE EVALUATION:
ARPC/DPB recommended denial noting the Career Enhancement office at
Grissom ARB sent the applicant’s PRF via FedEx on 20 Apr 04.
According to the FedEx tracker, it was received in Denver on 21 Apr
04. However, it was not delivered to ARPC/DPB until the FY05 board
had convened. According to ARPC/DPB, the applicant could not have
been considered by the FY05 board because his PRF was not received for
processing either by the suspense date or prior to the convening of
the board.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 17
Sep 04 for review and response. As of this date, no response has been
received by this office (Exhibit C).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. A review of the available evidence
reveals that on 20 Apr 04, the Career Enhancement office at Grissom
ARB forwarded the applicant’s FY05 PRF to HQ ARPC, where it was
received on 21 Apr 04. Therefore, it appears the PRF was received
before the suspense date of 30 Apr 04, and well before the board’s
convening date of 14 Jun 04. In view of the foregoing, we are
persuaded the PRF was forwarded for processing by the office of
primary responsibility (OPR) in sufficient time to include it in the
applicant’s record for consideration by the FY05 board, and the
failure to do so was due to circumstances beyond his control.
Accordingly, we recommend the applicant be considered for promotion to
lieutenant colonel by a Special Review Board, with inclusion of his
FY05 PRF.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, to include his Promotion Recommendation Form
(PRF), AF Form 709, prepared for consideration by the Fiscal Year 2005
(FY05) Line and Nonline Lieutenant Colonel Position Vacancy Promotion
Selection Board, be considered for promotion to the Reserve grade of
lieutenant colonel by a Special Review Board; that his record be
evaluated in comparison with the records of officers who were and were
not selected by the FY05 Line and Nonline Lieutenant Colonel Position
Vacancy Promotion Selection Board; and, if he is recommended for
promotion by a Special Review Board, the Air Force Board for
Correction of Military Records be advised of that recommendation at
the earliest practicable date so that all necessary and appropriate
actions may be completed.
If he is not recommended for promotion by the Special Review Board,
the office of primary responsibility advise him of the recommendation
of the Special Review Board.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to , to include his Promotion Recommendation Form
(PRF), AF Form 709, prepared for consideration by the Fiscal Year 2005
(FY05) Line and Nonline Lieutenant Colonel Position Vacancy Promotion
Selection Board, be considered for promotion to the Reserve grade of
lieutenant colonel by a Special Review Board; that his record be
evaluated in comparison with the records of officers who were and were
not selected by the FY05 Line and Nonline Lieutenant Colonel Position
Vacancy Promotion Selection Board; and, if he is recommended for
