APPLICANT REQUESTS THAT:
His selection record, to include the Officer Performance Report (OPR)
rendered for the period 16 July 2002 through 27 May 03, be considered for
promotion to the grade of lieutenant colonel for the Calendar Year 2003A
(CY03A) Lieutenant Colonel Central Selection Board by Special Selection
Board (SSB).

STATEMENT OF FACTS:
On 23 Feb 04, the Board considered and denied the applicant's request for
inclusion of his 27 May 03 OPR in his CY03 selection record. In his
original request, applicant contended that his supervisor prepared the OPR
prior to his May 2003 permanent change-of-station departure and the OPR
only required the wing commander's edits and signature. Feedback from the
wing commander assured him the OPR would be in his record for the 8 July
2003 promotion board. The OPR was not signed until 8 July 2003 and was not
placed in his selection record leaving the 15 Jul 02 OPR as the most recent
report in his selection record. For an accounting of the facts and
circumstances surrounding the applicant’s request and the rationale of the
earlier decision by the Board, see the Record of Proceedings at Exhibit E.
In further support of his request, applicant provided a statement from his
rater who states it was his intent for the OPR to be a matter of record
prior to the convening of the CY03 selection board. His complete
submission, with attachment, is at Exhibit F.

THE BOARD CONCLUDES THAT:
After again reviewing the applicant's request along with the additional
evidence provided, it is our opinion that corrective action is warranted in
this case. Applicant contends that his rater prepared the contested OPR
more than a month prior to the convening of the CY03 lieutenant colonel
selection board and it was his rater's intent for the OPR to be on file in
his selection record. It is our opinion that while his OPR was
accomplished in
accordance with the time limitations prescribed in the applicable
regulations, if not for the rater's untimely PCS departure, it appears
expeditious processing would have occurred to ensure the OPR would have
been completed in time for his promotion consideration. Given the support
he received from his rater, and having no reason to doubt his integrity in
this matter, we believe that the applicant was improperly disadvantaged due
to the absence of his most recent OPR and that relief is warranted.
Therefore, we recommend that his records be corrected to the extent
indicated below

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that:
a. The Officer Performance Report (OPR), rendered for the period 16
July 2002 through 27 May 2003, was signed by the rater in Section VI on 5
July 2003, and by the additional rater in Section VII on 6 July 2003.
b. The OPR rendered for the period 16 July 2002 through 27 May 2003,
was accepted for file in his Officer Selection Record on 7 July 2003.
It is further directed that his record, to include the above corrected OPR,
be consider for promotion to the grade of lieutenant colonel by a Special
Selection Board for the Calendar Year 2003A Central Lieutenant Colonel
Selection Board.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that:
a. The Officer Performance Report (OPR), rendered for the
period 16 July 2002 through 27 May 2003, was signed by the rater in Section
VI on 5 July 2003, and by the additional rater in Section VII on 6 July
2003.
b. The OPR rendered for the period 16 July 2002 through 27 May
2003, was accepted for file in his Officer Selection Record on 7 July 2003.
