APPLICANT REQUESTS:

A constructive reenlistment to change his  term  of  enlistment  (TOE)
from six to four years.

APPLICANT CONTENDS THAT:

Since he was reclassified out  of  his  guaranteed  career  field,  he
should be allowed to change his TOE from six to four years.

No supporting documents  were  submitted.   The  applicant’s  complete
submission is at Exhibit A.

STATEMENT OF FACTS:

The applicant entered into the Delayed Entry/Enlistment Program  (DEP)
on 31 May 2001.  On 23 October 2001, he enlisted in  the  Regular  Air
Force in the grade of E-3 for a period of four years in the guaranteed
General career field.  On 4 December 2001, the  applicant  elected  to
change his General career field to 1C231 (Combat Control Team), with a
six-year TOE.

The applicant’s current Duty  Air  Force  Specialty  Code  (DAFSC)  is
2A732, which defined means Non Destructive Inspection Apprentice.

AIR FORCE EVALUATION:

HQ AFPC/DPPAE recommends the application be denied.  DPPAE states that
the applicant initialed Block C of AF Form 3009, Change to  Enlistment
Agreement  -  United  States  Air  Force,  which  states,  “I  further
understand my term of enlistment will not  be  reduced  regardless  of
which AFSC I am classified into or if I fail to complete the  required
training in my classified skill.”  The applicant has not proven he was
misled into electing a six-year TOE.  The HQ AFPC/DPPAE evaluation  is
at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded  to  applicant  on  7
November 2003 for review and response.  As of this date,  no  response
has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the existence of error or injustice.  His contentions are duly  noted.
However, other than his own assertions, no evidence has been presented
to indicate that the applicant was miscounseled at the time he  signed
AF Form 3009 (Change to Enlistment Agreement).  We  therefore  believe
the applicant signed the cited document knowing he would have  a  six-
year commitment.  In view  of  the  foregoing  and  absent  sufficient
evidence to the contrary, we find no  compelling  basis  to  recommend
granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
