APPLICANT REQUESTS THAT:
He be considered for promotion to the grade of major by Special Selection
Board (SSB) for the Fiscal Year 2004 (FY04) Line and Health Professions
Major Selection Board.

STATEMENT OF FACTS:
In previous consideration of his case, applicant stated that he departed
the Regular Air Force on terminal leave on 10 Dec 02 and was transferred to
the Reserves on 1 Feb 03. He was not considered by the FY04 major's board
because of inaccurate guidance during his accession into the Air Force
Reserves. He was told that he needed to be part of the Reserve component
for at least one year before being eligible for promotion even though he
met the time in grade requirement. He later discovered that he was
eligible for the February board and did not meet the board because he did
not get a package into the board before the deadline. His rater and senior
rater agree that if they had the correct information they would have
immediately pulled him and recommended him for promotion.
His appeal was considered and denied by the Board on 21 Aug 03. The Board
stated that if the applicant were to provide evidence that the Reserve
position he was selected to fill was vacant on 10 Dec 02, his application
would be reconsidered. For an accounting of the Board's decision and the

On 22 Sep 03, applicant provided statements in support of his appeal and
requested reconsideration of his application. His complete submission is
at Exhibit F.

THE BOARD CONCLUDES THAT:
After thoroughly reviewing the additional statements provided in support of
his appeal, it appears that the Reserve position he was selected to fill
was apparently vacant on 10 Dec 02. Further, it appears that the applicant
and his supervisors were misguided with respect to his eligibility for
consideration for promotion by the FY04 selection board. We believe that
had the applicant been properly counseled, he would have taken the
appropriate measures to ensure he met the requirements for promotion
consideration. In an effort to ensure the fairest and most equitable
resolution in a manner that would be in the best interest of the applicant
and the Air Force, we believe that the appropriate corrective action would
be to grant the applicant promotion consideration by Special Review Board.
Accordingly, we recommend that his records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT to include AF Form 709, Promotion Recommendation, signed by
Major General --------, be considered for promotion to the grade of major,
Air Force Reserve, by a Special Review Board, and his records be evaluated
in comparison with the records of officers who were and were not selected
by the Fiscal Year 2004 Air Force Reserve Line and Health Professions Major
Position Vacancy Promotion Board, and if recommended for promotion by the
Special Review Board, the Air Force Board for Correction of Military
Records be advised of that recommendation at the earliest practicable date
so that all necessary and appropriate actions may be completed.
If he is not recommended for promotion by the Special Review Board, the
office of primary responsibility advise him of the recommendation of the
Special Review Board.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, to include the attached AF Form 709, Promotion
Recommendation, signed by Major General S--, be considered for promotion to
the grade of major, Air Force Reserve, by a Special Review Board, and his
records be evaluated in comparison with the records of officers who were
and were not selected by the Fiscal Year 2004 Air Force Reserve Line and
Health Professions Major Position Vacancy Promotion Board, and if
recommended for promotion by the Special Review Board, the Air Force Board
for Correction of Military Records be advised of that recommendation at the
earliest practicable date so that all necessary and appropriate actions may
be completed.
If he is not recommended for promotion by the Special Review Board,
the office of primary responsibility advise him of the recommendation of
the Special Review Board.
