APPLICANT REQUESTS THAT:
His DD Form 214 be corrected to reflect the award of the Armed Forces
Expeditionary Medal.

APPLICANT CONTENDS THAT:
The applicant did not provide any documentation to substantiate his
claim.
In support of the appeal, applicant provided a copy of his TDY in and
outprocessing checklist, a copy of Special Order TE-0346, a copy of
his Supplemental Evaluation Sheet, and a certificate.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force on 4 February 1999.
His Enlisted Performance Report for the period 4 February 1999 to 4
October 2000 contains the statement that the applicant was deployed to
Kuwait “in support of United Nations Security Council resolution 668.”
On 26 November 2001, the applicant was discharged under honorable
conditions (general) because of misconduct. He had served two years,
nine months and 22 days on active duty.

AIR FORCE EVALUATION:
AFPC/DPPPR states that they are unable to verify the applicant’s
eligibility for the Armed Forces Expeditionary Medal without the
necessary documentation. Although he stated he was in Kuwait and
Saudi Arabia for three months in each location, his records do not
substantiate this claim. Furthermore, his EPR states he was deployed
in support of a United Nations Security Council resolution, not in
support of an operation designated by the Joint Chiefs of Staff.
Therefore, they recommend denial of applicant’s request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 24 October 2003, a copy of the Air Force evaluation was forwarded
to the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

Although we find the applicant's actions which led to award of the Airman's Medal and two DFCs for his acts of heroism to be truly commendable, we find no evidence of either an error or an injustice in this case.
