APPLICANT REQUESTS THAT:

The 21 days of leave he used  when  he  made  a  permanent  change  of
station (PCS) to Soto Cano AB, Honduras be restored.

APPLICANT CONTENDS THAT:

When he was preparing to leave Minot AFB,  ND  his  passport  was  not
ready.  The technician at the passport office told him he could  still
go on leave and that his passport would  be  forwarded  to  his  leave
address.  He used 21 days of leave while waiting for his passport.  In
support of his application, he submits a memorandum from the  Military
Personnel Flight (MPF) Commander.

Applicant's complete submission,  with  attachments,  is  attached  at
Exhibit A.

STATEMENT OF FACTS:

During the time in period in question, the applicant was  assigned  to
Minot AFB, ND.  He went PCS to Soto Cano AB,  Honduras.   He  departed
Minot AFB on 23 March 2002 and arrived in Honduras on 30  April  2002.
He used 35 days of leave.

AIR FORCE EVALUATION:

AFPC/DPSFM states AFI 36-3003,  Military  Leave  Program,  para  6.19,
states  the  Financial  Services’  Office  (FSO)  computes  leave   or
authorized absences in  excess  of  allowed  travel  time,  permissive
temporary duty (PTDY), and proceed time, if applicable.  The

applicant was not present for duty or TDY during this timeframe.   The
FSO correctly charged the applicant 35 days  of  leave.   Furthermore,
the Minot MPF has taken steps to reeducate  their  passport  agent  to
prevent any future occurrences of this type.  Based on the information
provided they recommend the applicant’s  request  to  have  his  leave
restored by denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 1
Jun 01, for review and response.  As of this  date,  no  response  has
been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Sufficient relevant evidence has been presented  to  demonstrate
the existence of an error or injustice.  After reviewing the  evidence
of record, we  are  persuaded  that  the  applicant  was  miscounseled
concerning going on leave prior to his PCSing.  He was instructed that
since his passport was not ready to go on leave and that his  passport
would be forwarded to his leave address.  Based on the fact  that  was
misinformed by  the  MPF  technician,  we  recommend  his  records  be
corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT be corrected to show that 21 days of leave  were
added to his leave account commencing 1 October 2003.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction for Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116) it is directed that:

      The pertinent military records of the Department of the Air
Force relating to                 , be corrected to show that 21
days of leave were added to his leave account commencing 1 October
2003.
