APPLICANT REQUESTS THAT:
His Servicemembers’ Group Life Insurance (SGLI) election for "No"
coverage be honored and he be reimbursed for the monthly premiums
deducted from his April 2001 through December 2002 pay for SGLI and
FSGLI coverage.

APPLICANT CONTENDS THAT:
He cancelled the SGLI on 28 July 1999 but on April 2001, premiums were
deducted from his pay until present. He has cancelled the SGLI on 29
July 1999 and April 2001 the SGLI started coming out of his paycheck
again. He went to the MPF when he noticed the mistake in April 2001
and the MPF said they would fix and to just hold on to his SGLV 8286
for proof. It was never fixed up to present day and he has paid $420
into the SGLI, which he did not want.
In support of his application, he submits a copy of the 1999 SGLV form
8286, Servicemmbers’ Group Insurance Election and Certificate and
copies of his leave and earning statements.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the Air Force in
the grade of senior airman.
Applicant paid SGLI premiums from 1 April 2001 to 1 December 2002.

AIR FORCE EVALUATION:
AFPC/DPW recommended denial due to lack of sufficient evidence to
support the claim. After receiving the applicant’s DD Form 149 dated
19 December 2002, they need additional information to sufficiently
evaluate his claim and make an appropriate recommendation. On 27
January 2003, they sent a letter to the applicant requesting the
additional information. They did not receive any response from the
applicant..

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was forwarded to the
applicant on 4 April 2003, for review and comment. As of this date,
no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or injustice. After a thorough review of
the evidence of record and applicant’s submission, we are not
persuaded the applicant should be reimbursed for the SGLI premiums he
paid from April 2001 to December 2002. Applicant’s contentions are
duly noted; however, we do not find these assertions, in and by
themselves, sufficiently persuasive to override the rationale provided
by the office of primary responsibility. We therefore agree with
their recommendation and adopt the rationale expressed as the basis
for our decision that the applicant has failed to sustain his burden
of having suffered either an error or an injustice. In view of the
above and absent persuasive evidence to the contrary, we find no
compelling basis to recommend granting the relief sought.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

The applicant's request to be reimbursed for his SGLI premiums was considered and denied by the Board on 15 April 2003. Lackland AFB notified its servicemembers of the pending change to SGLI coverage by using the base bulletins, newspapers, and the April 2001 pay statements. It would appear that he was notified of the SGLI increase and we find no evidence to support his miscounseling contention.
