APPLICANT REQUESTS THAT:
He be reconsidered for selection to attend in-residence Intermediate
Service School (ISS) by Special Selection Board (SSB) for the Calendar Year
2002 (CY02) ISS selection board.

APPLICANT CONTENDS THAT:
His Officer Performance Report (OPR) closing on 11 Jul 02 should have been
in his selection folder prior to the 16 Sep 02 board. His squadron
forwarded the OPR on 12 Jul 02 but the Military Personnel Flight (MPF) did
not receive it until 8 Oct 02. The OPR was in the Operations Group and the
wing Executive's office for over 57 days. He received his AF Form 3849,
PME/AFIT/RTFB Officer Worksheet, signed by the wing commander in August
2002, with a copy of the 11 Jul 02 OPR. During the period between 11 Jul
02 and the board convening, he was reassigned to another unit and his rater
was reassigned to another base. He inquired about the status of the OPR
but was informed that it was in the wing commander's office and that it
would be in records in time for the selection board. Applicant believes
that his accomplishments over his career qualify him for ISS and omission
of his current OPR prevented his selection.
In support of his request, applicant provided a copy of his OPR closing 11
Jul 02, his AF 3849, his OPR tracking record, and a statement from his
commander. His complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
Applicant is currently serving on extended active duty in the grade of
major, having assumed that grade effective and with a date of rank of 1 May
01. He was considered and not nominated for in-residence ISS attendance by
the CY02 CSB, which convened on 16 Sep 02.

AIR FORCE EVALUATION:
AFPC/DPAP recommends approval. DPAP states that OPRs are due to the MPF
not later than 30 days after close-out and due to AFPC not later that 60
days after close-out. In this case, the dates would be 9 Aug 02 and 15 Sep
02, respectively. However, the OPR was not posted in his Officer Selection
Record (OSR) until 9 Oct 02. Although he should ensure his OSR is up-to-
date, based on the group and wing executive office's failure to properly
process the OPR within the prescribed suspense, DPAP recommends he be
reconsidered for ISS. The DPAP evaluation is at Exhibit C.
AFPC/DPPPO recommends denial. DPPPO states that the OPR was signed by his
rater on 13 Sep 02, by his additional rater on 17 Sep 02, and by the
reviewer on 7 Oct 02. As such, the OPR was not a matter of record for the
16 Sep 02 ISS board. Therefore, SSB consideration is not warranted. The
DPPPO evaluation is at Exhibit D.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Copies of the Air Force evaluations were forwarded to the applicant on 11
Apr 03 for review and comment within 30 days. As of this date, this office
has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. In this respect, we believe that the
applicant's record was incomplete at the time he was considered for ISS
attendance by the CY02 ISS selection board. We agree with the Officer
Professional Military Education Branch that because of his rating chain's
failure to process the OPR closing 11 Jul 02 in a timely manner, and
through no fault of his own, the OPR was not included in the selection
process. Whether or not this information was significant enough to alter
the results of the CY02 selection board is a question we are unable to
answer based on the evidence presented. Nevertheless, we believe that the
applicant was improperly disadvantaged because of the absence of the OPR.
Accordingly, in order to resolve any potential injustice to the applicant,
we believe that any doubt should be resolved in his favor and that his
record should be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that:
a. The AF Form 707A, Field Grade Officer Performance Report (OPR),
rendered for the period 13 August 2001 through 11 July 2002, be amended to
reflect that the additional rater and reviewer signed the report on 14
September 2002.
b. The OPR closing 11 July 2002 was placed in his Officer Selection
Record on 15 September 2002.
It is further recommended that his record, to include the OPR closing 11
July 2002, be considered by Special Selection Board for the Calendar Year
2002 Intermediate Service School Central Selection Board.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show:
a. The AF Form 707A, Field Grade Officer Performance Report
(OPR), rendered for the period 13 August 2001 through 11 July 2002, be
amended to reflect that the additional rater and reviewer signed the report
on 14 September 2002.
b. The OPR closing 11 July 2002 was placed in his Officer
Selection Record on 15 September 2002.
It is further directed that his record, to include the OPR closing 11
July 2002, be considered by Special Selection Board for the Calendar Year
2002 Intermediate Service School Central Selection Board.

In this case this date would have been 19 Sep 01. He filed this application first, because due to a late OPR his senior rater screened an incomplete record and second, the selection board screened an incomplete record. In this respect, we note that in accordance with applicable Air Force instructions, the OPR closing on 21 Jul 01 was not required to be on file at AFPC until after the date the ISS selection board adjourned.

Based on these statements, we recommend that the duty title be corrected. In his appeal to this Board, applicant has requested that he be considered for ISS, which is the appropriate PME recommendation that should have been indicated on the OPR. Therefore, we recommend the duty title and PME recommendation be changed on the contested OPR and that his corrected report be considered for promotion and ISS by SSBs.

The OPR closing 23 Jun 97 recommends SSS in residence.
