APPLICANT REQUESTS THAT:

In the  applicant’s  request  for  reconsideration,  he  requests  that  his
general discharge be upgraded to honorable.

STATEMENT OF FACTS:

The applicant was discharged with a  general  (under  honorable  conditions)
discharge on 30 September 1991 because of misconduct (drug abuse).   At  the
time of his separation, he was credited with 5 years, 5 months  and  8  days
of total active duty service.

On 1 February 1993, the applicant submitted an  application  requesting  his
general discharge be upgraded to honorable.  On  22  July  1993,  the  Board
considered and denied the applicant’s  request.   A  complete  copy  of  the
Record of Proceedings is attached at Exhibit E.

The applicant submitted a letter dated 23 February  1996,  again  requesting
that his general discharge be upgraded to honorable.  On 20 March  1996,  he
was informed that his request did not meet the criteria for  reconsideration
by the Board (Exhibit F).

On 9 November 2002, the applicant submitted a DD Form 293,  Application  for
the Review of Discharge or Dismissal from the Armed  Forces  of  the  United
States, again requesting that his discharge be upgraded  to  honorable.   In
support of his request,  he  provided  a  personal  statement,  two  college
transcripts, and five character references (Exhibit G).

Pursuant to the  Board’s  request,  the  Federal  Bureau  of  Investigation,
Clarksburg, West Virginia, indicated on the  basis  of  the  data  furnished
they were unable to locate an arrest record (Exhibit H).

THE BOARD CONCLUDES THAT:

After reviewing the facts of this case and  the  evidence  provided  by  the
applicant in support of his request for reconsideration, we do  not  believe
a  reversal  of  the  earlier  decision  is  warranted.   The  applicant  is
requesting that his discharge be upgraded  based  on  his  successful  post-
service adjustment.  He  has  provided  limited  evidence  that  appears  to
indicate he is a productive member of his community.  However we  note  that
only two of the character references (one from his spouse) was  prepared  in
connection with his most recent request.  We do not find  that  the  limited
evidence provided supports upgrading his discharge to fully honorable  based
on the seriousness of the infractions he committed against  the  good  order
and discipline of the service.  In view of the above and in the  absence  of
evidence  by  the  applicant  showing  his   service   was   inappropriately
characterized as “under honorable conditions,” the  applicant’s  request  is
not favorably considered.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of probable material error or injustice; that the  application
was denied without a personal appearance;  and  that  the  application  will
only be reconsidered  upon  the  submission  of  newly  discovered  relevant
evidence not considered with this application.
