APPLICANT REQUESTS THAT:

He receive Special Selection Board  (SSB)  consideration  by  the  CY01B  (5
November 2001) (P0501B) central lieutenant colonel selection board  with  an
amended Officer Selection Brief which correctly reflects his flying data.

APPLICANT CONTENDS THAT:

For the P0501B lieutenant colonel promotion board, the  total  flying  hours
indicated on his Air  Force  Officer  Selection  Brief  indicates  0  flying
hours.  The correct hours should have shown 1761.3 total flying hours

In support  of  his  request  applicant  provides  a  copy  of  his  Officer
Selection Brief, and a Flight  Records  Validation/Correction  letter.   The
applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Data extracted from the military personnel data system  (MilPDS)  indicates
the applicant’s Total Active Federal Military Service Date as 6 July  1983.
He is currently serving on active duty in the grade of major, with  a  date
of rank and an effective date of 1 March 1995.

The applicant’s Field Grade Officer Performance Reports  (OPRs)  since  his
promotion to major beginning with the rating  period  31 January  1995  and
ending on 16 July 2001 have overall ratings of “Meets Standards.”

He was considered and not selected for promotion to the grade of lieutenant
colonel by the P0501B (5  November  2001)  and  P0502B  (12 November  2002)
lieutenant  colonel  selection  boards.   His  record  indicates   he   was
considered and not selected for  promotion  by  5  selection  boards.   The
applicant currently has an established date of separation (DOS) of 31  July
2003.

AIR FORCE EVALUATION:

AFPC/DPPPO recommends the application be  denied.   DPPPO  states  that  the
applicant received an Officer Preselection Brief and the  instruction  sheet
in early August 2001.  The instruction advises  officers  to  contact  their
local Host Aircrew Rated Management Systems (HARMS) and have them provide  a
letter with the correct flying data.  This letter can  either  be  forwarded
to AFPC/DPPPOO or  attached  to  a  letter  to  the  board  president.   The
applicant was a nonselect by  the  CY01B  Lieutenant  Colonel  Line  Central
Selection Board, which convened on 5  Nov  01.   He  has  not  provided  any
information regarding what action he took prior to the  board  convening  to
ensure his duty history was correct.  DPPPO states he has  not  demonstrated
“reasonable diligence” in the maintenance  of  his  records,  and  does  not
support  promotion  reconsideration  on   this   issue.     The   AFPC/DPPPO
evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 6 December 2002, a copy of the Air Force evaluation was forwarded to  the
applicant for review  and  comment.   As  of  this  date,  this  office  has
received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  We have reviewed  the  available  evidence
pertaining to the applicant’s assertions related to his flying data  on  his
Officer Selection Brief (OSB) for the CY 2001B  central  lieutenant  colonel
selection board,  to  include  a  copy  of  his  flight  records  validation
statement, and we are unpersuaded that SSB consideration is warranted.   His
contentions in this regard are duly noted; however, in our opinion, the  Air
Force office  of  primary  responsibility  has  adequately  addressed  these
contentions and we are in agreement  with  their  assessment  of  his  case.
Accordingly, in the absence of documentation showing  what  action  he  took
prior to the board convening which demonstrates  “reasonable  diligence”  in
the maintenance of his records, SSB consideration with an amended OSB  based
on this issue is not appropriate.   In  light  of  the  above,  we  find  no
compelling basis upon which to recommend granting the relief sought in  this
application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of probable material error or injustice; that the  application
was denied without a personal appearance;  and  that  the  application  will
only be reconsidered upon the submission of newly  discovered  evidence  not
considered with this application.
