APPLICANT REQUESTS THAT:
In the applicant’s request for reconsideration, he requests that his
Reenlistment Eligibility (RE) code be changed.

STATEMENT OF FACTS:
The applicant was discharged with an honorable discharge on 15
January 1990 because of expiration of term of service. An RE-2X was
assigned (First-term, second-term, or career airman considered but not
selected for reenlistment under the SRP (Selective Reenlistment
Program)). At the time of his separation, he was credited with 6
years of active duty service.
On 1 October 1993, the applicant’s request that his RE code be
upgraded was considered and denied by the Air Force Board for
Correction of Military Records. See the Record of Proceedings at
Exhibit C.
On 5 May 2002, the applicant submitted a request for reconsideration,
contending that his military record was impeccable prior to an
accident with a government vehicle. To support this assertion, the
applicant provided a personal statement, two character references and
copies of his performance reports. The applicant’s complete
submission is at Exhibit D.

THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice warranting a change in the
applicant’s RE code. While we can detect no error in the applicant’s
current RE code, we believe a change to the code would be appropriate
based on the following considerations. The applicant’s military
record was impeccable prior to the incident that led to the vacation
of his NCO status and his nonselection for reenlistment. With the
exception of this isolated incident, he served honorably and well for
a total of six years. Because this episode occurred shortly before
the expiration of his term of enlistment, he did not have the
opportunity to regain his status as an NCO and reverse his
ineligibility to reenlist. In view of the totality of the
circumstances of this case and the character references provided by
the applicant, we believe his continued ineligibility to reenlist
constitutes an injustice and that he should be afforded the
opportunity to reenlist in the armed services. Whether or not he is
successful will depend on the needs of the service and our
recommendation in no way guarantees that he will be allowed to return
to the Air Force or any branch of the service. Therefore, we
recommend that applicant’s record be corrected to reflect an RE code
of “1J” (eligible to reenlist but elects separation).

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that at the time of his
discharge on 15 January 1990, he was issued a Reenlistment Eligibility
(RE) code of “1J.”

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to, be corrected to show that at the time of his
discharge on 15 January 1990, he was issued a Reenlistment Eligibility
(RE) code of “1J.”
