APPLICANT REQUESTS THAT:
He be released from his three-month extension of service, and his
original date of separation of 8 Sep 02 be reinstated.

APPLICANT CONTENDS THAT:
When he received orders for a permanent change of station (PCS) to
Korea, he was miscounseled that he had to extend his enlistment. In
fact, due to his departure date from Edwards AFB on 6 Oct 00 for a one
year assignment, he was not required to extend his current enlistment.
He is not due to enter the extension until Sep 02. He reported to
his current duty location at Hurlburt Field on 14 Oct 01.
In support of his appeal, the applicant provided copies of his
extension document and his PCS orders.

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) indicates
that the applicant is currently serving on active duty in the grade of
senior airman, having been promoted to that grade on 9 Sep 01. His
Total Active Federal Military Service Date (TAFMSD) is 9 Sep 98.
Available documentation indicates that the applicant enlisted on 9 Sep
98 for a period of four years. On 18 Aug 00, the applicant requested
an extension of his enlistment for three months, which
was approved on 31 Aug 00. As a result, his date of separation
(DOS)was changed from 8 Sep 02 to 8 Dec 02.

AIR FORCE EVALUATION:
AFPC/DPPAE recommended that the applicant’s three-month extension be
replaced with a one-month extension, giving him a new DOS of 8 Oct 02.
AFPC/DPPAE indicated that according to the applicant’s Date Eligible
for Return from Overseas (DEROS) of 25 Oct 01 and his expiration term
of service (ETS) of 8 Sep 02, he should only have extended his
enlistment for one month rather than 3 months in order to have enough
retainability to return to the states.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 31
May 02 for review and response. As of this date, no response has been
received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. Having carefully reviewed this
application, we agree with the recommendation of AFPC/DPPAE and adopt
their rationale as the basis for our decision that the applicant has
been the victim of an error or an injustice. Accordingly, we
recommend that the applicant’s records be corrected to reflect that he
extended his enlistment for a period of one month rather than three
months. While we note the applicant’s request that he be released
from his three-month extension and that his original DOS be
reinstated, it appears that because of his DEROS and ETS, he needed
the month extension to have enough retainability to return from
overseas to the states. Therefore, we believe our above
recommendation for correction of his records is proper and fitting
relief.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that the extension of his
9 Sep 98 enlistment for a period of four years, executed on 18 Aug 00
and approved on 31 Aug 00, was for a period of one month, rather than
three months.

of Section 1552, Title 10, United States Code (70A Stat 116), it is
