APPLICANT REQUESTS THAT:

His Servicemembers’ Group Life  Insurance  (SGLI)  election  for  “NO”
coverage, dated 10 February 1999, be honored and he be reimbursed  for
the monthly premiums deducted  from  his  pay  for  SGLI  coverage  of
$250,000 since 1 April 2001.

APPLICANT CONTENDS THAT:

On 10 February 1999, he  had  cancelled  his  SGLI.   The  SGLI  rates
increased in April 2001 and premiums were automatically deducted  from
his military pay.  He was not aware that he had to submit a  new  form
to cancel SGLI.

In support of the applicant's  appeal,  he  submits  a  squadron  out-
processing checklist, SGLV 8286, Servicemen's'  Group  Life  Insurance
Election Statement, a  personal  statement,  and  military  leave  and
earnings statements.

STATEMENT OF FACTS:

The applicant is presently serving in the Air  Force  Reserve  in  the
grade of major.

Monthly SGLI premiums of $20 were deducted from  the  applicant's  pay
starting 1 Apr through Dec 01 and monthly premiums of  $9  for  family
SGLI starting 1 Nov 01 through 1 Jan 02.

On 19 Nov 01, the applicant signed and declined SGLI coverage on  SGLV
Form 8286, Servicemen's' Group Life Insurance Election Statement.





The remaining relevant facts pertaining to this application, extracted
from the applicant's military records, are contained  in  the  letters
prepared by the appropriate offices of the Air Force at Exhibit C.

AIR FORCE EVALUATION:

ARPC/DPS recommend the member  be  allowed  to  reaccomplish  an  SGLI
Election Statement declining coverage on 27 June 2001.  The  applicant
outprocessed the 43 FTS on 27 Jun  01.   His  outprocessing  checklist
showed that his intention was to cancel SGLI.   However,  the  43  FTS
failed to give  him  an  SGLV  Form  8286,  Servicemen's'  Group  Life
Insurance  Election  Statement,  to  decline  the  coverage  prior  to
outprocessing the unit.  Orders were not  received  by  the  applicant
until 4 Oct 01 placing him into an inactive status.  Stop loss actions
were taken on 2 Oct 01, making the  4  Oct  01  order  invalid.   SGLI
deductions continued until his declination on 19 Nov 01.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the Air  Force  evaluation  was  forwarded  to  the
applicant on 17 May 2002, for review and comment within 30  days.   As
of this date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Sufficient relevant evidence has been presented  to  demonstrate
the existence of an error or injustice warranting declining of SGLI in
June 2001. After reviewing the evidence of  record,  we  believe  that
some relief is warranted.  Therefore, we agree with the recommendation
of the Air Force that the applicant's pay records should be  corrected
to show that he declined  SGLI  coverage  on  27  June  2001  with  an
effective date of 1 July 2001. We considered  applicant's  request  to
show that he declined coverage in April 2001; however, we believe that
he was provided proper notification on the new SGLI program.  In  this
respect, his LES  for  April  2001  through  March  2002  reveal  that
premiums for SGLI were being deducted from his pay.  In  view  of  the
above determination, we recommend his  records  be  corrected  to  the
extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, be corrected  to  show  that  he  declined  the
Servicemembers’ Group Life Insurance (SGLI) coverage on 27 June  2001,
with an effective date of 1 July 2001.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that on 1 July 2001,
he declined the Servicemembers’ Group Life Insurance (SGLI) coverage
removed from any debt thereafter.
