APPLICANT REQUESTS THAT:
He be released from a Servicemembers’ Group Life Insurance (SGLI) debt
incurred between the period of Feb 96 and Mar 99.

APPLICANT CONTENDS THAT:
The reasons the applicant believes the records to be in error or
unjust and the evidence submitted in support of the appeal are at
Exhibit A.

STATEMENT OF FACTS:
The relevant facts pertaining to this application are contained in the
letter prepared by the appropriate office of the Air Force.
Accordingly, there is no need to recite these facts in this Record of
Proceedings.

AIR FORCE EVALUATION:
The Directorate of Customer Assistance, HQ ARPC/DPS reviewed this
application and recommended denial. DPS stated that since the
applicant was still a member of a Reserve unit, he would have received
a monthly leave and earnings statement indicating the debt for the
SGLI premiums. Had the applicant actually been transferred to an
inactive status at the time in question, SGLI coverage would have
automatically been discontinued. A complete copy of the evaluation is
at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 14
April 2000 for review and response. As of this date, no response has
been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. After careful
consideration of all the facts and circumstances of applicant’s case,
we are persuaded by the documentation provided that the applicant’s
Reserve unit outprocessing did not cover SGLI coverage. We noted that
the applicant made numerous attempts to correct the SGLI problem, but
to no avail. It was not until he received a letter from the Defense
Finance and Accounting Service (DFAS) notifying him of the debt that
he was finally informed that, at the time of his outprocessing, he
should have completed SGLV Form 8286 declining coverage. In view of
the foregoing, we recommend that in the interest of justice, the
applicant should receive full reimbursement for the SGLI debt, to
include any interest and penalty fees, and his records be corrected as
indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that on 6 January 1996, he
executed an SGLV Form 8286, Servicemen’s Group Life Insurance (SGLI)
Election Certificate, declining any and all coverage, effective 1
February 1996.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to APPLICANT be corrected to show that, on 6 January
1996, he executed an SGLV Form 8286, Servicemen’s Group Life Insurance
(SGLI) Election Certificate, declining any and all coverage, effective
1 February 1996
