APPLICANT REQUESTS THAT:

Her Date of Rank (DOR) be changed to reflect 8 months  constructive  service
credit.

APPLICANT CONTENDS THAT:

Her work experience was not included in her record for constructive  service
credit.

In support of her appeal, the applicant provided a letter from  the  Houston
Medical Center, dated 19 October 1998, and an Employee Payroll History  from
1 August 1997 through 31 December 1998.

STATEMENT OF FACTS:

The applicant is currently serving on extended active duty in the  grade  of
first lieutenant.

The applicant’s date of rank (DOR) is 1 January 2001.

AIR FORCE EVALUATION:

HQ AFPC/DPMAF2 recommended denial.  They indicate that  the  applicant  only
had a total of 12 weeks where she worked 40 hours  or  more  but  was  never
considered full time.  Per AFI 36-2005, Table 2.5, Rule 41, note  14  states
an individual receives full time professional experience by  being  employed
40 hours per week in  one  or  more  places  of  employment  with  exception
granted for individuals employed 32-39 hours per week  and  considered  full
time employees must submit a letter from their employer verifying  they  are
full time  employees.   The  applicant  was  never  considered  a  full-time
employee at the Houston Medical Center as verified with  the  Nurse  Manager
at the Houston Medical Center on 17 December 1998 by HQ AFPC/DPAMF.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 25 January 2002, a copy of the Air Force evaluation was forwarded to  the
applicant for review and response within  thirty  (30)  days.   As  of  this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of  probable  error  or  injustice  warranting  a  change  in  the
applicant’s date of  rank  to  reflect  eight  months  constructive  service
credit.  The applicant contends that her work experience  was  not  included
in her record for constructive service credit.  The Board notes that AFI 36-
2005  indicates  that  an  individual  receives   full   time   professional
experience by being employed 40 hours per week in  one  or  more  places  of
employment, and exceptions are granted for individuals employed 32-39  hours
per week and considered full time employees but they must  submit  a  letter
from their employer verifying they are  full  time  employees.   The  letter
from the nurse  manager  at  the  Houston  Medical  Center  is  duly  noted;
however, the  nurse  manager  does  not  indicate  that  the  applicant  was
considered  a  full  time  employee.   Additionally,  it  appears  the  same
individual confirmed to Air Force officials that  the  applicant  was  never
considered a full time employee.  In  view  of  the  foregoing  and  in  the
absence of evidence  to  the  contrary,  we  find  no  compelling  basis  to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of probable material error or injustice; that the  application
was denied without a personal appearance;  and  that  the  application  will
only be reconsidered  upon  the  submission  of  newly  discovered  relevant
evidence not considered with this application.
