APPLICANT REQUESTS THAT:
The undesirable discharge he received in 1952 be upgraded to honorable.

RESUME OF CASE:
On 20 February 1997, the AFBCMR considered and denied applicant’s above
request. A complete copy of the Record of Proceeding is attached at
Exhibit C.
In support of his request for reconsideration, applicant provided a
letter with attachments detailing his post-service activities (Exhibit
D). Pursuant to the Board’s request, the Federal Bureau of
Investigation, Clarksburg, WV, indicated on 29 December 2000, that, on
the basis of data furnished, they were unable to locate an arrest
record (Exhibit E)

THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. After reviewing the documents
submitted by the applicant, the Board was impressed with his
considerable post-service achievements. They also noted the favorable
FBI report and the length of time that has passed, over 48 years, since
the applicant was discharged. After weighing all factors, a majority of
the Board felt that the applicant should be granted clemency and his
discharge upgraded to honorable. Therefore, a majority of the Board
recommends that the applicant’s record be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 1 October 1952,
he was honorably discharged and furnished a Honorable Discharge
certificate.

By majority vote, the members voted to correct the records, as
recommended. Mr. Joseph Roj voted to upgrade the applicant’s

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:
The pertinent military records of the Department of the Air
Force relating to XXXXXX., XXX-XX-XXXX, be corrected to show that
on 1 October 1952, he was honorably discharged and furnished an
Honorable Discharge certificate.

The appropriate Air Force offices evaluated applicant's request and provided advisory opinions to the Board recommending the application be denied (Exhibit C). The advisory opinions were forwarded to the applicant/counsel for review and response (Exhibit D). The facts and opinions stated in the advisory opinions appear to be based on the evidence of record and have not been rebutted by counsel/applicant.

The applicant’s request under AFI 36-2401 to have the contested EPR removed from his records was denied by the Evaluation Reports Appeals Board (ERAB). The AFPC/DPPPWB evaluation, with attachments, is at Exhibit C. AFPC/DPPPEP recommends the application be denied. After a thorough review of the evidence of record and applicant’s submission, we are not persuaded that the contested report is an inaccurate assessment of his performance during the contested rating period.
He was medically cleared on 7 Aug 00 and enlisted in the RegAF on 5 Sep 00 in the grade of SSgt (E-5) with a DOR of 5 Sep 00.
