APPLICANT REQUESTS THAT:
His date of rank (DOR) be changed to make him eligible to test for
promotion to technical sergeant (TSgt) (E-6) in 2002 vice 2003.

APPLICANT CONTENDS THAT:
Delays at the recruiter and Military Entrance Processing Station (MEPS)
prevented him from enlisting as early as he had intended and caused him
to receive a DOR as a staff sergeant (E-5) that makes him ineligible to
test for promotion to TSgt in 2002.

STATEMENT OF FACTS:
The applicant was a member of the Massachusetts Air National Guard
(ANG) and served an active duty tour from 25 Dec 97 to 4 Sep 00,
completing his tour in the grade of TSgt. Based on a conditional
release from the ANG, the applicant initiated documentation on 5 Jul 00
to enlist in the Regular Air Force (RegAF). He was medically cleared
on 7 Aug 00 and enlisted in the RegAF on 5 Sep 00 in the grade of SSgt
(E-5) with a DOR of 5 Sep 00.

AIR FORCE EVALUATION:
The Chief, Enlisted Accessions and Enlistment Bonuses evaluated this
application in regards to the applicant’s DOR and recommends denial of
his request to change it to make him eligible to test for promotion in
2002.
The applicant’s enlistment was processed in a timely manner and his DOR
correctly established to equal his 5 Sep 00 enlistment date. For a
prior service applicant to begin enlistment processing on 5 Jul 00 and
enter active duty by 1 Aug 00 is considered unrealistic. The applicant
has failed to adequately document enlistment processing delays that
would warrant a 1 Aug 00 DOR.

The Chief, Inquiries/AFBCMR Section evaluated this application in
regards to the applicant’s request to test for promotion to TSgt in
2002 and also recommends denial of the applicant’s request. The
applicant would require a DOR of 1 Aug 00 or earlier to be eligible to
test in 2002.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Copies of the evaluations were forwarded to the applicant for review
and comment within 30 days. To date, a response has not been received.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinions and recommendations of the Air
Force offices of primary responsibility and adopt their rationale as
the basis for our conclusion that the applicant has not been the victim
of an error or injustice. Therefore, in the absence of evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice; that
the application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly

This TIG error prevented him from testing for MSgt in 2011 and 2012, and denied him consideration for promotion on both the FY11 and FY12 Master Sergeant Selection Boards. The applicant’s request under AFI 36-2401 to have the contested EPR removed from his records was denied by the Evaluation Reports Appeals Board (ERAB). The AFPC/DPPPWB evaluation, with attachments, is at Exhibit C. AFPC/DPPPEP recommends the application be denied. After a thorough review of the evidence of record and applicant’s submission, we are not persuaded that the contested report is an inaccurate assessment of his performance during the contested rating period.
