APPLICANT REQUESTS THAT:
His 1998 general discharge from the Air National Guard (ANG) be
upgraded to honorable.

APPLICANT CONTENDS THAT:
He was young, inexperienced and fell in with the wrong people. He has
tried to turn his life around and would like another chance to serve.
He provides some post-service information.
His complete submission is at Exhibit A.

STATEMENT OF FACTS:
The applicant was discharged for drug abuse from the Massachusetts ANG
on 1 Sep 98 with a general characterization. He had 3 years, 6 months
and 5 days of service.
Pursuant to the Board's request, the Federal Bureau of Investigation,
Washington, D.C., indicated that on the basis of the data furnished,
they were unable to locate an arrest record
The remaining relevant facts pertaining to this application, extracted
from the applicant's military records (Exhibit B), are contained in
the letters prepared by ANG/DPFP and HQ MAANG/ESSO (Exhibit C).
Accordingly, there is no need to recite these facts in this Record of
Proceedings.

AIR FORCE EVALUATION:
The Personnel Policy Staff Officer, ANG/DPFP, reviewed the appeal and
provided his rationale for recommending denial. Also provided as an
attachment is a memo from the HQ Massachusetts ANG Executive Support
Staff Officer recommending denial.
A complete copy of the evaluation, and attachments, is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was forwarded to the
applicant on 13 Jul 01 for review and comment within 30 days. As of
this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable injustice regarding the applicant’s request
to have his general discharge from the ANG upgraded to honorable. No
evidence has been presented which would lead us to believe his
discharge was improper or contrary to the directive under which it was
effected. Nevertheless, in view of the applicant’s successful
transition to civilian life, as evidenced by the post-service
documentation he has provided and the FBI report indicating he has
been a law-biding citizen, we are of the opinion that upgrading his
discharge to honorable, based solely on clemency, would be
appropriate. However, the applicant has not provided sufficient
evidence to warrant altering his reenlistment eligibility. The
applicant should understand that upgrading his discharge to honorable
in no way obligates any of the Services to accept him for enlistment.
Accordingly, we recommended that the applicant’s be corrected to the
extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that, on 1 September 1998,
he was honorably discharged from the Air National Guard and the
Reserve of the Air Force and furnished an Honorable Discharge
Certificate.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to , be corrected to show that, on 1
September 1998, he was honorably discharged from the Air National
Guard and the Reserve of the Air Force and furnished an Honorable
Discharge Certificate.
