APPLICANT REQUESTS THAT:
He be considered for promotion by Special Selection Boards (SSBs) for the
Calendar Year 2000 (CY00A and CY00B) Central Major Selection Boards.

APPLICANT CONTENDS THAT:
His records were incorrect at the time he was considered for promotion to
the grade of major.
The applicant states that prior to the board, he attempted to have his duty
title corrected; however, in doing so his previous duty title was erased.
In addition, he successfully completed his EC-130H Instructor in-flight
check ride which the squadron orderly room updated prior to the board.
However, at the time he was considered for promotion several lines of
assignment duty history were missing from his Officer Selection Brief
(OSB).

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of captain.
The applicant was considered and not selected for promotion to the grade of
major by the CY00A and CY00B Central Major Selection Boards.

AIR FORCE EVALUATION:
The Chief, Appeals and SSB Branch, AFPC/DPPPA, reviewed the application and
states that applicant’s first attempt to have the “MCC/Chief, Plans and
Services” entry (effective 2 April 1998) updated was in July 2000 and he
must accept some responsibility on this issue. The applicant admits that
he had a correction made to his duty history to reflect the “Flight
Commander” entry (effective 12 August 1999) prior to the board. However,
he does not state he made any attempt to recheck his assignment history
prior to the board to ensure the correct data was present in the PDS.
Regardless, his 7 August 1998 and 7 August 1999 Officer Performance Reports
(OPRs) either had the duty title “Mission Crew Commander/Chief, Plans and
Exercises” in the duty title in Section III or the duties were discussed in
the job description in Item 2, Section III. The applicant also contends
the duty title of “EC-130H Instructor/Flight CC” (effective 2 November
1999) should also have been included on his CY00A OSB, since he completed
his check ride on that same date. However, even though the orderly room
updated the PSD prior to the board, there is no evidence AFPC approved the
duty title prior to the board. Furthermore, there is no evidence the
applicant ensured the duty title had been updated prior to the board.
Therefore, they recommend the application be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the evaluation was forwarded to the applicant on 15
December 2000, for review and response within 30 days. However, as of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. In this respect, we note that
prior to the CY00A board, the applicant attempted to have his duty history
corrected; however, in doing so other duty titles were removed.
Furthermore, he completed his EC-130H Instructor in-flight check ride which
the squadron orderly room updated prior to the CY00A board. As a result,
at the time of his promotion considerations, several lines of assignment
duty history were missing from his OSBs. While it cannot be conclusively
determined whether or not this was the sole reason for his nonselections
for promotion by the boards in question, we do believe that it served to
deprive him of fair and equitable promotion consideration. Furthermore, we
believe he made a reasonable effort to ensure that his records were correct
prior to the convening of the boards in question. In view of the above, we
recommend his corrected record be considered by Special Selection Board
(SSB) beginning with the CY00A board.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, to include an Officer Selection Brief (OSB) reflecting his
duty titles “EC-130H Instructor/Flight CC,” effective 2 November 1999;
“Flight Commander,” effective 12 August 1999; and “MCC/Chief, Plans and
Exercise,” effective 2 April 1998, be considered for promotion by a Special
Selection Board for the CY00A Central Major Selection Board.
If he is not selected for promotion by the CY00A Central Major Selection
Board, it is further recommended that his record, to include an OSB
reflecting his duty title “Wing Tactical Deception Officer,” effective
15 August 2000, be considered for promotion by an SSB for the CY00B Central
Major Selection Board.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, to include an Officer Selection Brief (OSB)
reflecting his duty titles “EC-130H Instructor/Flight CC,” effective 2
November 1999; “Flight Commander,” effective 12 August 1999; and
“MCC/Chief, Plans and Exercise,” effective 2 April 1998, be considered for
promotion by a Special Selection Board for the CY00A Central Major
Selection Board.
If he is not selected for promotion by the CY00A Central Major
Selection Board, it is further directed that his record, to include an OSB
reflecting his duty title “Wing Tactical Deception Officer,” effective
