He be awarded the Purple Heart (PH) Medal.

APPLICANT CONTENDS THAT:
In March 1968 he was awarded the Silver Star for jettisoning ignited flares
through flames while he was serving as a loadmaster on a UC 123B which
sustained two direct hits on the left engine and flap area during a mission
in Vietnam. As a result he sustained a macular hole in his right eye.
In support of the application, the applicant provides a copy of his
separation record, a copy of a letter from a physician, a copy of a Times-
Herald news article and his DD Form 214.

STATEMENT OF FACTS:
The applicant entered active duty in the Regular Air Force on 24 November
1954. Serving as an aircraft loadmaster, he was progressively promoted to
the grade of master sergeant, released from active duty on 31 January 1975
and retired on 1 February 1975. He was credited with 20 years, 2 months
and 7 days active military service.
The applicant earned the Silver Star, Distinguished Flying Cross, Air Medal
with 6 oak leaf clusters (OLCs), National Defense Service Medal, Air Force
Longevity Service Award Ribbon with 4 Bronze OLCs, the Air Force Good
Conduct Medal with 3 Bronze OLCs, Small Arms Expert Marksman Ribbon,
Vietnam Service Medal with 1 Bronze Service Star and the Republic Vietnam
Campaign Medal.

AIR FORCE EVALUATION:
The Recognition Programs Branch, AFPC/DPPPR, indicated that on 17 August
2000 their office notified the applicant of the criteria required for the
award of the Purple Heart Medal and to provide additional information to
include any eyewitness statements, which would substantiate his claim. The
applicant failed to respond to this request and there is no evidence in the
applicant's records that he had been injured as a result of direct enemy
action. Therefore, DPPPR recommends the applicant's request be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force Evaluation was forwarded to the applicant for
review and response. As of this date, this office has received no response
(Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case including his award
of the Silver Star for jettisoning ignited flares while serving as a
loadmaster on a UC 123 B aircraft that sustained two direct hits on the
left engine during a mission in Vietnam. However, after thorough review of
the applicant's submission and his medical records, we found that there was
no evidence that supported his contention that he was wounded during the
mission. Therefore, in the absence of evidence to the contrary, we agree
with the opinion of the Air Force and find no compelling basis to recommend
granting the relief sought in this application.

The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.

The applicant’s complete submission is at Exhibit A. In addition, his Airman Performance Report (APR) rendered for the period 30 November 1964 through 16 June 1965 states that he flew 17 missions into Vietnam during the rating period. Although AFPC has administratively corrected his record to reflect award of the AM basic and the Vietnam Service Medal (VSM), there is no evidence he was ever submitted for an additional AM.
