RESUME OF CASE:
In an application, dated 14 August 1998, the applicant requested his
selection for retraining be nullified; he be returned to Air Force
Specialty Code (AFSC) 3E4X1; he be promoted to the grade of master sergeant
effective and with date of rank as if selected by the 98E7 promotion cycle;
and he be assigned to the XXXX Civil Engineering Squadron (CES), at XXXX
AFB.
On 29 June 1999, the Board considered and granted the applicant’s requests
(Exhibits A through F).
In a letter, dated 8 December 1999, the applicant requests assignment to
the XXXX CES at XXXX AFB. In support of his request, applicant submits
statements from the XXXX CES Deputy Chief, Operations Flight and the XXXX
CES Chief of Operations, indicating there is currently a surplus and
unavailability of an E-7 position at XXXX AFB, and an urgent need for
individuals within his career field at XXXX AFB. The applicant’s complete
submission is attached at Exhibit G.
THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. A majority of the Board
previously determined the process in which the applicant was selected for
retraining was tainted. As such, the majority of the Board recommended and
the Director, Air Force Review Boards Agency approved, the correction of
the applicant’s records to show that he was not selected for retraining;
remained in Air Force Specialty Code 3E4X1; was promoted to the grade of
master sergeant, effective and with date of rank (DOR) of 1 October 1998;
and was reassigned to the XXXX Civil Engineering Squadron, XXX AFB, XXXX.
The applicant now requests that he be reassigned to the XXX CES at XXXX
AFB, XXXX, and submits statements from the XXXX CES Deputy Chief,
Operations Flight, and the XXXX CES Chief of Operations. Based on these
statements it appears there is a surplus and unavailability of an E-7
position at XXXX AFB, but an urgent need for qualified individuals within
his career field at XXXX AFB. In view of this, and given the previous
decision by this Board, we believe that equity dictates that applicant be
provided the requested relief. Therefore, we recommend his records be
corrected to the extent indicated below.
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that his request for assignment to the
XXXX Civil Engineering Squadron, XXXX AFB, XXXX, was approved by competent
authority.
