APPLICANT REQUESTS THAT:
His records be corrected to reflect the addition of the Fifth Oak Leaf
Cluster (5OLC) to the Air Medal (AM) and China War Memorial Medal.

RESUME OF THE CASE:
On April 14, 1980, the Board considered and denied an application
pertaining to the subject applicant, in which he requested that his
records be corrected to reflect the addition of an Oak Leaf Cluster to
the Air Medal and Distinguished Flying Cross. A complete copy of the
Record of Proceedings is attached at Exhibit H (with Exhibits A and
C).
On August 11, 1998, the Board again considered and denied the
applicant’s appeal, in which he requested that his records be
corrected to reflect the addition of the Fifth Oak Leaf Cluster to
the Air Medal and Distinguished Flying Cross, and award of the China
War Memorial Medal. A complete copy of the Addendum to Record of
Proceedings is attached at Exhibit I (with Exhibits D through G).

APPLICANT CONTENDS THAT:
He has provided documentation which shows he was authorized to receive
the Air Medal (5OLC).
He believes his records should reflect award of the China War Memorial
Medal.
In support of his appeal, the applicant provided a copy of DA Form
1577, Authorization for Issue of Awards.

AIR FORCE EVALUATION:
Pursuant to the Board’s request, the Awards and Decorations Section,
AFPC/DPPPR, reviewed the applicant’s most recent submission and
recommended denial of his request that his records be corrected to
reflect award of the Air Medal (5OLC). According to DPPPR, the Army
is not authorized to make determinations regarding award of the Air
Medal for World War Two (WWII) veterans. In DPPPR’s view, the
applicant has not provided documentation showing a written
recommendation for the Air Medal for anti-submarine patrols was
submitted into official channels. Therefore, he is not eligible for
an additional Oak Leaf Cluster to the Air Medal.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 27
Jul 00 for review and response. As of this date, no response has been
received by this office (Exhibit L).

THE BOARD CONCLUDES THAT:
1. In earlier findings, we determined that there was insufficient
evidence to warrant any corrective action regarding the applicant’s
request that his records be corrected to reflect award of the Air
Medal (5OLC) and China War Memorial Medal. We have reviewed the
applicant’s most recent submission and find it insufficient to warrant
a reversal of our previous determinations in this case. Therefore, in
the absence of evidence which shows to our satisfaction that the
applicant was entitled to the Fifth Oak Leaf Cluster to the Air Medal
or that the China War Memorial Medal was a decoration authorized for
inclusion in his military records, we adhere to our prior decisions
and conclude that no basis exists to act favorably on his requests.
2. The applicant's case is adequately documented and it has not been
shown that a personal appearance with or without counsel will
materially add to our understanding of the issues involved.
Therefore, the request for a hearing is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
