The reasons the applicant believes the records to be in error or
unjust and the evidence submitted in support of the appeal are at
Exhibit A.

STATEMENT OF FACTS:
The relevant facts pertaining to this application are contained in the
letter prepared by the appropriate office of the Air Force.
Accordingly, there is no need to recite these facts in this Record of
Proceedings.

AIR STAFF EVALUATION:
The Officer Promotion and Appointment Branch, AFPC/DPPPO, reviewed
this application and recommended denial. A complete copy of the
evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR STAFF EVALUATION:
Applicant reviewed the advisory opinion and furnished a response which
is attached at Exhibit E.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable injustice. While the applicant has failed to
submit sufficient evidence showing he was promoted to the grade of
captain, we do note that the applicant was recommended for promotion
to the grade of captain based on his outstanding leadership, paramount
devotion to duty, and his achievements as a first lieutenant. We
further note that the applicant was a highly decorated navigator of
World War II, to include the Distinguished Flying Cross and Air Medal
with nine oak leaf clusters, with over 52 missions to his credit.
Therefore, in recognition of the applicant’s heroic service to his
country, and in the interest of justice, we are inclined to grant the
applicant’s request. Accordingly, we recommend that the applicant’s
records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that he was promoted to
the grade of captain, Officers’ Reserve Corps, Army of the United
States (Air Corps), effective 17 Aug 45, and that, on 18 Aug 45, he
was relieved from active duty in the grade of captain rather than
first lieutenant.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to XX, be corrected to show that he was promoted to the
grade of captain, Officers’ Reserve Corps, Army of the United States
(Air Corps), effective 17 Aug 45, and that, on 18 Aug 45, he was
relieved from active duty in the grade of captain rather than first
lieutenant.

On 2 April 1944, the applicant was appointed a temporary second lieutenant (2LT), Air Corps, Army of the United States, and was voluntarily ordered to extended active duty. On 23 October 1945, the applicant was recommended for promotion to the grade of first lieutenant (1LT) based on his service record and because it was presumed that if he had not been a POW, he would have been promoted. He was promoted to the grade of captain, Reserve of the Air Force, with an effective date of 1 July 1955.

He includes Army/Air Corps officers’ letters, dating from 1945-46, recommending his promotion to major and asserting he was recommended for promotion to captain on or about 5 Mar 42. 295, dated 24 Oct 44, the applicant was promoted to the grade of captain effective that date. After a thorough review of the evidence of record and the applicant’s submission, we are not persuaded that he should be promoted to the grade of major.
The AAM 1OLC is listed on the OSB reviewed by the CY00B Major Selection Board; however, neither the citation nor the order was on file in the OSR.
