ECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: 99-00429
INDEX CODE: 100, 107
COUNSEL: NY DIVISION OF
VETERANS AFFAIRS
HEARING DESIRED: No
Applicant requests that he be issued a DD Form 215 (Correction of DD
Form 214, Certificate of Release or Discharge From Active Duty) to
reflect award of the Air Force Longevity Ribbon and M16 qualification
and that his date of birth (DOB) on his DD Form 214 be changed from
8 Aug 48 to 15 Aug 48. Applicant's submission is at Exhibit A.
The appropriate Air Force office evaluated applicant's request and
provided an advisory opinion to the Board recommending the application
be denied (Exhibit C). The advisory opinion was forwarded to the
applicant/counsel for review and response (Exhibit D). As of this
date, no response has been received by this office.
After careful consideration of applicant's request and the available
evidence of record, we find insufficient evidence of error or
injustice to warrant corrective action in regard to his request that
he be issued a DD Form 215 to show award of the Air Force Longevity
Ribbon and M16 qualification. Absent persuasive evidence applicant
was denied rights to which entitled, appropriate regulations were not
followed, or appropriate standards were not applied, we find no basis
to disturb the existing record. The facts and opinions stated in the
advisory opinion appear to be based on the evidence of record and have
not been rebutted by applicant. We note that applicant has been
issued a corrected DD Form 215 reflecting his DOB correction as he
requested.
Accordingly, applicant's request is denied.
The Board staff is directed to inform applicant of this decision.
Applicant should also be informed that this decision is final and will
only be reconsidered upon the presentation of new relevant evidence
which was not reasonably available at the time the application was
filed.
Members of the Board Mr. Richard A. Peterson, Ms. Patricia D. Vestal,
and Mr. Gary Appleton considered this application on 6 July 1999 in
accordance with the provisions of Air Force Instruction 36-2603, and
the governing statute, 10, U.S.C. 1552.

The advisory opinions were forwarded to the applicant for review and response (Exhibit D). Applicant's responses to the advisory opinions are at Exhibit E. After careful consideration of applicant's request for a disability rating and the available evidence of record, we find insufficient evidence of error or injustice to warrant corrective action with respect to his medical condition. A complete copy of their evaluation is attached at Exhibit D. AFPC/DPPPR states that the applicant is not eligible for award of the Air Force Good Conduct (AFGC) Medal. Since he received his first Article 15 during this assignment, he would not be eligible for a decoration upon completion of his overseas tour. After reviewing the evidence of record, we are not persuaded that the applicant’s records are in error or that he has been the victim of an injustice.
