RESUME OF CASE:
Applicant submitted an application to the Board dated 13 January 1998. On
28 July 1998, the Board considered and denied applicant’s request that his
general (under honorable conditions) discharge be upgraded to honorable.
A complete copy of the Record of Proceedings is attached at Exhibit E.
In a letter dated 19 November 1998, applicant states that his mother was
fighting for her life after a six year bout with leukemia. Nearing the
end of her life she asked him to try to rectify the discharge that he
received. He would like to grant his mother one of her last requests
along with his own desires to be able to earn an honorable discharge.
After his discharge he has had several jobs and has been employed with the
law enforcement for 20 years to present, and holds the position of
sergeant.
In support of his request, he has provided statements from the community
attesting to his character and reputation. He requests that his
application be reconsidered. Applicant’s request, with attachments, is
attached at Exhibit F.

THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. This Board considered
applicant’s request for upgrade of his discharge and recommended denial.
However, they indicated that if he provided post-service documentation
they would reconsider his request. Applicant has provided documentation
reflecting upon his accomplishments and character since his discharge from
the Air Force. After reviewing this we are persuaded that applicant has
been a productive member of society. We recognize the adverse impact of
the discharge applicant received; and, while it may have been appropriate
at the time, we believe it would be an injustice for applicant to continue
to suffer its effects. Accordingly, we find that corrective action is
appropriate as a matter of equity and on the basis of clemency.
Therefore, we recommend his discharge be upgraded to honorable.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that on 1 November 1963, he was
honorably discharged and furnished an Honorable Discharge certificate.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of
Section 1552, Title 10, United States Code (70A Stat 116), it is directed
that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 1 November 1963, he
was honorably discharged and furnished an Honorable Discharge certificate.

The appropriate Air Force office evaluated applicant's request and provided an advisory opinion to the Board recommending the application be denied (Exhibit C). The advisory opinion was forwarded to the applicant for review and response (Exhibit D). After careful consideration of applicant's request and the available evidence of record, we find insufficient evidence of error or injustice to warrant corrective action.
