RESUME OF CASE:
On 25 Mar 94, the Board considered and denied applicant’s request.
A complete copy of the Record of Proceedings, with attachments, is
attached at Exhibit C.
On 20 May 99, applicant provided additional documentation requested
reconsideration of his application (see Exhibit D).

THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. After reviewing the
additional documentation submitted, including the statement from the
Security Officer, dated 25 May 99, who stated that their unit would
benefit greatly if the applicant were allowed to join as a Traditional
Guard member, we are persuaded that applicant’s RE code should be
changed. While we certainly do not condone the reason for his
receiving the Article 15, it appears that he now wishes to serve in
the Air National Guard (ANG). Therefore, after noting his overall
service record and in consideration of his honorable discharge, we
believe he should be given an RE code of “3K” which will afford him
the opportunity to apply for a waiver to enlist in the armed services.
Whether or not he is successful will depend on the needs of the
service and our recommendation in no way guarantees that he will be
allowed to return to the Air Force or any branch of the service.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that his RE code, issued
in conjunction with his honorable discharge on 3 Apr 90, was 3K.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating APPLICANT, be corrected to show that his reenlistment
eligibility (RE) code, issued in conjunction with his honorable
discharge on 3 April 1990, was 3K.
