MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR 

Having carefully reviewed this application, we agree with the recommendation of the Air 
Force and adopt the rationale expressed as the basis for our decision that the applicant has been 
the victim of either an error or an injustice.  Therefore, under the authority delegated in AFI 
36-2603, the applicant’s records will be corrected as set forth in the accompanying Memorandum 
for the Chief of Staff signed by the Executive Director of the Board or his designee.

The applicant requests a constructive reenlistment to permit retirement the first day of the 

month following High Year of Tenure (HYT).  He filed a timely request within three years of 
discovering the alleged injustice. 

Title 10, USC 509 restricts an airman from extending any one enlistment in excess of 

48 months.  The applicant extended his 25 Sep 92 (three-year) enlistment a total of 48 months.  He 
needs an additional three months to retire effective 1 Dec 99.  We give this date since it is the first 
day of the month following the applicant’s HYT month of Nov 99. 

We recommend the applicant be given relief by granting him a two-year, 1 Dec 97 

as 30 Nov 99 and permit 

constructive reenlistment.  Th 
retirement effective 1 Dec 99.
