Having carefully reviewed this application, we agree with
the recommendation of the Air Force and adopt the rationale
expressed as the basis for our decision that the applicant has
been the victim of either an error or an injustice.

Director of the Board or his designee.

The applicant requests he be granted a constructive reenlistment to enable him to retire the
first day of the month following his High Year of Tenure (HYT). He filed a timely request within
three years of discovering the alleged injustice.
Title 10, USC 509 restricts an airman from extending any one enlistment in excess of
48 months. The applicant extended his 12 Jan 90 (four year) enlistment a total of 48 months. He
needs an additional four months to retire effective 1 May 98. We give this date since it is the first
day of the month following the applicants HYT month of Apr 98.
We recommend the applicant be given relief by granting him a two-year, 1 May 96
constructive reenlistment. This would establish his date of separation as 3 1 Apr 98 and allow him
to retire effective 1 May 98.
