MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR 
SUBJECT : 

Having carefully reviewed this application, we agree with 

the recommendation of the Air Force and adopt the rationale 
expressed as the basis for our decision that the applicant has 
been the victim of either an error or an injustice.  Therefore, 
under the authority delegated in AFI 36-2603, the applicant's 
records will be corrected as set forth in the accompanying 
Memorandum for the Chief of Staff signed by the Executive 
Director of the Board or his designee.

The applicant requests a constructive reenlistment to permit retirement the first day of the 

month following High Year of Tenure (HYT).  He filed a timely request within three years of 
discovering the alleged injustice. 

Title 10, USC 509 restricts an airman from extending any one enlistment in excess of 

48 months.  The applicant extended his 19 Dec 88 (six-year) enlistment a total of 48 months.  He 
needs an additional month to retire effective 1 Jan 99.  We give this date since it is the first day of 
the month following the applicant’s HYT month of Dec 98. 

We recommend the applicant be given relief by granting him a two-year, 1 Jan 97 

constructive reenlistment. This would establish his date of separation as 3 1 Dec 98 and permit 
retirement effective 1 Jan 99.
