MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
Having carefully reviewed this application, we agree with the recommendation of the Air
Staff and adopt the rationale expressed as the basis for our decision that the applicant has been
the victim of either an error or an injustice. Therefore, under the authority delegated in AFI 36-
2603, the applicant's records will be corrected as set forth in the accompanying Memorandum for
the Chief of Staff signed by the Executive Director of the Board or his designee.

1. The requested correction cannot be accomplished administratively at this headquarters. -

2. The member is requesting that his record be changed to show that he added his spouse to his
Reserve Component Survivor Benefit Plan (RCSBP) within one year of his marriage.

3. The following is an analysis of the circumstances surrounding the case:
a. The member made an election for children only with full, immediate coverage on 4 Apr
83. He was not married at the time of this election.
b. The member remarried 18 May 96
c. The member states that shortly after his marriage, he contacted the Air Reserve Personnel
Center to obtain the information necessary to add his spouse to the RCSBP and was told that he
could not accomplish this until applying for retired pay. He fixther states that at the time of
applying for retired pay, he was told that he could not add his spouse to his RCSBP as the one
year time limit had expired.
4. Per Title 10, United States Code, Section 1448(a)(B)(5), an individual can elect RCSBP
coverage for a spouse if he does so within one year of marriage. Although there is no evidence
that an injustice occurred, the member exhibited good intentions by inquiring as to the applicable
procedures within this one year time limit.
5. Recommendation: Recommend the member's request be approved. If the decision is to grant
the relief sought, the member's record should be corrected to show that he elected full, immediate
coverage for spouse and children (Option CF) under the RCSBP, effective 15 May 97.

The appropriate Air Force office evaluated applicant's request and provided an advisory opinion to the Board recommending the application be denied (Exhibit C). The member is requesting that his record be corrected to allow his participation in the Reserve Component Survivor Benefit Plan (RCSBP). The member states that he did not have the package until much later than the mailing date.
