as the basis for our decision that the applicant has been the
victim of either an error or an injustice. Therefore, under the

The applicant requests a constructive reenlistment to enable her to retire the first day of the
month following High Year of Tenure (HIT). She filed a timely request within three years of
discovering the alleged injustice.
Title 10, USC 509 restricts an airman from extending any one enlistment in excess of
48 months. The applicant extended her 15 Dec 88 (six year) enlistment a total of 48 months. She
needs an additional month to retire effective 1 Jan 99. We give this date since it is the first day of
the month following the applicant’s HYT month of Dec 98.
t
We recommend the applicant be given relief by granting her a two-year, 1 Jan 97
constructive reenlistment. This would estabIish her date of separation as 3 1 Dec 98 and allow her to
retire effective 1 Jan 99.
