Applicant requests that his records be corrected to reflect award 
of  the Vietnam  Service Medal, commendation or campaign ribbons, 
and  his  service  in  Indochina.  Applicant's  submission  is  at 
Exhibit A. 

The  appropriate Air  Force  office  evaluated  applicant's request 
and provided  an advisory opinion to  the  Board  recommending the 
application  be  denied  (Exhibit C).  The  advisory  opinion  was 
forwarded to the applicant for review and response  (Exhibit D). 
As of this date, no response has been received by this office. 
After  careful  consideration  of  applicant's  request  and  the 
available evidence  of  record, we  find  insufficient  evidence  of 
error or injustice to warrant corrective action.  The facts and 
opinions stated in the advisory opinion appear to be based on the 
evidence  of  record  and  have  not  been  rebutted  by  applicant. 
Absent  persuasive evidence applicant was denied rights to which 
entitled,  appropriate  regulations  were  not  followed,  or 
appropriate  standards  were  not  applied,  we  find  no  basis  to 
disturb the existing record. 

Accordingly, applicant's request is denied. 
The Board staff is directed to inform applicant of this decision. 
Applicant should also be informed that this decision is final and 
will  only be  reconsidered upon the presentation of new relevant 
evidence  which  was  not  reasonably  available  at  the  time  the 
application was filed.

SUBJECT: Application for Correction of Military Records (DD Form 149) 

1.  REQUESTED ACTION.  Applicant requests correction of his DD Form 214 to reflect award 
of the Vietnam Service Medal, commendation or campaign ribbons, and service in Indochina. 
2.  BASIS FOR lU3QUEST.  Applicant provided three copies of PACAF Form 100, Hostile Fire 
Pay Certification. 

3.  FACTS. 

a.  Applicant served on Active Duty 19 Jan 72-1 6 Jan 76.  His DD Form 2 14 indicates in 
Item 19, “No” for service in Indochina or Korea since 5 Aug 64.  He received the National 
Defense Service Medal and Air Force Good Conduct Medal. 

b.  The cutoff date for award of the Vietnam Service Medal is 28 Mar 73.  If TDY, an indi- 
vidual is required to have spent 30 consecutive days in the Area of Operations (Vietnam, Thai- 
land, Laos or Cambodia) in direct support of the operations in Vietnam.  The applicant was sta- 
tioned at Beale AFB CA at the time, but his records do not reflect any overseas service or TDY. 
C.  The only applicable PACAF Form 100 is the one for the month of February.  However, 

this form does not reff ect the number of days, the country, or his reason for being there. 
4.  DISCUSSION.  The Hostile Fire Pay Certificate was for income tax purposes, and the indi- 
vidual receiving this certificate only had to fly into Vietnam, Thailand, Cambodia or Laos for 
one day to receive the certificate, and did not have to be in direct support of operations in Viet- 
nam.  The applicant has failed to provide any documentation to show that he spent 30 consecu- 
tive or 60 nonconsecutive days in Vietnam, Thailand, Cambodia or Laos prior to 28 Mar 73.  He 
was not stationed overseas during his three+ years in the service.  We can not verify his eligibil- 
ity for the Vietnam Service Medal, for any additional awards or decorations, or that he is eligible 
for Item 19 to be marked “Yes.”

5.  RECOMMENDATION. 

We recommend disapproval of the applicant's request for his DD Form 214 to reflect award 

of the Vietnam Service Medal, commendation or campaign ribbons, and service in Indochina.
