APPLICANT REQUESTS THAT:
His Officer Selection Brief (OSB) reviewed by the Calendar Year 1997
(CY97C) Lieutenant Colonel Central Selection Board be updated to reflect
the award of the Air Medal (AM) and AM with one oak leaf cluster (10LC) and
he be granted Special Selection Board (SSB) consideration.
APPLICANT CONTENDS THAT:
His OSB for the CY97C selection board failed to include the awards of the
Air Medals. They were submitted and approved before the board date but
were not included in his OSB.
In support of his appeal, the applicant submitted copies of the Air Medal
orders and citations, and a copy of his OSB for the CY9@C board.
Applicant's complete submission is attached at Exhibit A.
STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the grade of
major.
He has one nonselection for promotion by the CY97C Lieutenant Colonel
Selection Board.
The applicant received an AM for the period 8 February 1997 through 20
March 1997 and the 1OLC was awarded for the period 23 March 1997 through 4
May 1997. The special orders GA-59 are dated 15 July 1997.
AIR FORCE EVALUATION:
The Appeals and SSB Branch, AFPC/DPPPA,. reviewed the application and
stated that every Air Force member is responsible for ensuring their record
is correct. They receive an officer pre-selection
brief (OPB) before meeting a promotion board that contains data that will
appear on the OSB at the central board. The written instructions attached
to the brief instructs them to carefully examine the brief for completeness
and accuracy. All concerns and discrepancies should be addressed through
their servicing Military Personnel Flight (MPF) and if necessary, their
chain of command and senior rater. Officers will not be considered by SSB
if, in
exercising reasonable diligence, the officer should have
discovered[ an error or omission in his records and could have
taken timely corrective action. Even though the AM and AM, 1OLC
,were nonexistent at the time the OPBs were generated, the instructions
that accompanied the brief still apply to the officer and the award of the
contested decorations. The award of the AM and AM (10LC) were a matter of
record prior to the promotion
board. II: was the applicant's responsibility to notify the board
of their omission. Copies of the decorations could have been
faxed to the board president, accompanied by a letter to ensure
they were properly considered by the original promotion board. AFI 36-2803
states that citations and special orders must be forwarded within 60 days
of the date of the special order. As such, Lhe special order and citation
were processed well within the guidelines of the governing directive and
neither were due for file until 13 September 1997, nor were they required
to be on file for the board. It is noted they were filed on 5 August 1997
in accordance with policy. Based on the evidence provided, DPPPA
recommended denial.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the evaluation was forwarded to the applicant on 27 January 1998
for review and comments within 30 days. As of this date, no response has
been received in this office.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. insufficient relevant evidence has been presented
to
demonstrate the existence of probable error or injustice. The
applicant believes his record should be placed before an SSB
because thie citations for the two Air Medals were missing from
his
record. After reviewing the evidence presented, the Board does
not
believe approval of the requested relief is warranted. The Air Force
acknowledges the contested medals were not a part of applicant's record
when it was considered by the CY97C selection board. However, in
accordance with the governing instruction, they

were not required to be on file at the time the board convened. As the Air
Force notes, central boards evaluate the entire officer record and it is
highly unlikely that the absence of the medals was the sole basis for his
nonselection. Arguably, the contested medals. could not have been listed
on applicants pre-selection brief because they did not exist at that time;
however, we note that they were awarded on 15 duly 1997, before the
selection board convened. The applicant could have faxed information
regarding the medals to the board president, accompanied by a letter to
ensure they were properly considered. In view of the above, we agree with
@he opinion and recommendation of the Air Forte and adopt their .rationale
as the basis for our conclusion that the applicant has not been the victim
of an error or injustice. Therefore, the Board recommends that the
application be denied.
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.
