Applicant requests that his general discharge be upgraded to
honorable. Applicant's submission is at Exhibit A .
The appropriate Air Force office evaluated applicant's request
and provided an advisory opinion to the Board recommending the
application be denied (Exhibit C) . We note that the applicant's
WD AGO Form 53-58, Enlisted Record and Report of Separation, has
been administratively corrected to reflect corporal as his
highest grade held. The advisory opinion was forwarded to the
applicant for review and response (Exhibit D). As of this date,
no response has been received by this office.
After careful consideration of applicant's request and the
available evidence of record, we find insufficient evidence of
error or injustice to warrant corrective action. The facts and
opinions stated in the advisory opinion appear to be based on the
evidence of record and have not been rebutted by applicant.
Absent persuasive evidence applicant was denied rights to which
entitled, appropriate regulations were not followed, or
appropriate standards were not applied, we find no basis to
disturb the existing record.
Accordingly, applicant's request is denied.
The Board staff is directed to inform applicant of this decision.
Applicant should also be informed that this decision is final and
will only be reconsidered upon the presentation of new relevant
evidence which was not reasonably available at the time the
application was filed.

The applicant, while serving in the grade of private first class, was discharged fiom the
Air Force on 28 May 50 under the provisions of AFR 39-10 (Expiration of Term of Service) and
received a General Discharge. He served 03 years, 00 months and 00 days of total active
service.

Requested Action. The applicant is requesting upgrade of his general discharge to
honorable. He further request his WD Form 53-58 be corrected to show in item 38 "Highest
Grade Held" to read Corporal. Also, he claims his discharge does not show that he worked in a
clinic giving shots.
Basis for Request. Applicant claims the reason he went AWOL was because his wife had
a miscarriage and bleeding very bad and he was scared to leave her. In his original request of 15
Sep 74, he stated that other members discharged for the Same thing or worse received an
honorable discharge if they made their loss time good.
Discussion. Applicant's master personnel record does not contain a discharge case
however, record does contain a report of proceeding whereby the applicant was reduced fiom
grade of Corporal to Private First Class on 12 Jul48. The WD Form 53-58 shows his primary
Military Occupational Specialty (MOS) as clerk, which is correct. In addition, it shows the
applicant had 135 days of loss time. This case has been reviewed for separation processing and
there are no errors or irregularities causing an injustice to the applicant. The discharge complies
with directives in effect at the time of his discharge. Administrative relief is being taken and
AFPCDPPRSO will prepare a DD Form 21 5 to show applicant's highest grade held was
Corporal.
Recommendation. Denial. Applicant did not identifjl any specific errors in
processing nor provide facts which warrant an upgrade in the discharge he received*
filed a timely request.

The commander advised applicant that if his recommendation is approved, that his discharge would be described as entry level separation and that he would be ineligible for reenlistment in the Air Force. Applicant appeared before a Board of Officers without counsel convened to review the pertinent facts and circumstances and make recommendation to the discharge authority if he should be discharged fiom the service.
However, a WD AGO Form 24A (Service Record) has recorded a Summary Court Martial Order Number 19 for conviction for being AWOL for the period 17 Jan 50 to about 27 Jan 50 which resulted in a sentence to confinement at hard labor and forfeiture of$50.00 pay. He has not filed a timely request. Applicant alleges that he was never convicted of a criminal offense, and that the 103 days of lost time on his DD Form 2 14 are incorrect.
