Applicant requests that h i s discharge be changed to Honorable
conditions. Applicant's submission is at Exhibit A.
The appropria$e Air Force offices evaluated applicant's request
and provided an advisory opinions to the Board recommending the
application be denied (Exhibit C). The advisory opinions were
forwarded to the counsel for review and response (Exhibit D).
As of this date, no response has been received by this office.
After careful consideration of applicant's
request and the
available evidence of record, we find the application untimely.
Applicant d i d not file this request within three years after the
alleged error or injustice was discovered, or reasonably could have
been discovered, as required by 10, U.S.C. 1552 and Air Force
Regulation 31-3. Applicant has not shown a plausible reason for
the delay in filing, and we are not persuaded that the record
raises issues of error or injustice which require resolution on the
merits. Thus, we cannot conclude it would be in the interest of
justice to excuse applicant's failure to file in a timely manner.
Accordingly, applicant's request is denied as untimely.
The Boara staff is directed to inform applicant of this decision.
Applicant' should also be informed that this decision is final and
will only be reconsidered upon the presentation of new relevant
evidence which was not reasonably available at the time the
application was filed.

He served 15 years and 21 days of active duty and received $15,000.00' in severance pay. A complete copy of the evaluation is attached at Exhibit C. The Chief, Selection Board Secretariat, AFMPC/DPMAB, reviewed the application and recommends denial.
APPLICANT CONTENDS THAT: On 21 October 1992, he went to the AFB Personnel Center to check on the SBP status of hi insure that she was enrolled, and also to enroll two newly adopted small children (of his deceased son) during the SBP Open Enrollment Election period. Applicant's complete submission is attached at Exhibit A. At the time, he did not receive any paperwork pertaining to the fact that his wife or his children were enrolled.
