Applicant’s Request

The application for discharge review was received on 20060406 . The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable . Decision

A documentary discharge review was conducted in Washington, D.C. on 20070308 . After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was 3-2 that the character of discharge shall change to: HONORABLE/ HOMOSEXUAL ADMISSION , authority: MILPERSMAN 1910- 148, S eparation Code HRB .

050228 :  Applicant notified of intended recommendation by reason of homosexuality as evidenced by Applicant's statement that he admitted to being a homosexual. Applicant advised that if separation is approved, the characterization of service may be general under honorable conditions . PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20050324 by reason of homosexuality - homosexual admission with a service characterization of general ( under honorable conditions) (A) . After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but not equitable ( B and C ).

A general (under honorable conditions) character of service is appropriate when the quality of a member’s service has been honest and faithful and significant negative aspects of the member’s conduct or performance of duty outweighed positive aspects of the member’s service. The evidence of record shows that Applicant’s service was marred only by one nonjudicial punishment proceeding for violation of Article 86 of the UCMJ for a one - day period of unauthorized absence. The Board found that this negative aspect did not outweigh the Applicant’s five years and three months of service sufficiently to merit a general (under honorable conditions) characterization of service. Relief granted.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. Representation at a personal appearance hearing is recommended but not required.
