Applicant ’s Request

The application for discharge review was received on 20060607 . The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable and the Narrative Reason for Separation be changed to Hardship/Medical . The Applicant requests a documentary record discharge review. The Applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20070329 . After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant ’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge and reason for discharge shall not change. The discharge shall remain General (Under Honorable Conditions) by reason of misconduct due to a pattern of misconduct.

040112 Applicant to Makalapa Branch Medical Clinic on 031027 without being able to clearly articulate the reason for his doing so, though he eventually related that he knew he was crazy and needed help.
         Upon that initial presentation he was sent to Tripler AMC for direct admission, with a diagnosis of Bipolar Disorder. Current episode Manic. He was seen on an outpatient basis 031103 and again today.
         Assessment:
AXIS I: Bipolar disorder, Type I, most recent episode manic (episode medication-inducted?) EPTE, aggravated by service.
         Disability for continued military service: severe.
         Disability for occupational functioning: moderate.
         Panic disorder without
Agoraphobia EPTE, aggravated by service.
         Disability for continued military service: moderate.
         Disability for occupational functioning: mild.
         Alcohol dependence, in early full remission.
         AXIS II: Deferred.
         AXIS III: No diagnosis.
         AXIS IV: Psychiatric condition and sequellae - he does not wish to be separated from the USMC, though he recognizes that this is necessary.

         Plan: Outpatient care while pending PEB. Medication stabilization and supportive therapy.
         Military Recommendation: It is recommended that this service member be medically separated from service. The Medical Board concurs with the above findings and diagnoses, and recommends that the case be referred to the Physical Evaluation Board for disposition. At the present time, the service member is considered fully competent to be discharged to his own custody.

040415:  NJP for violation of UCMJ, Article 92 : On board MCBR on or about 1532, 040411 willingly violated a lawful order by consuming alcohol : Reference: Battalion NJO on 031204, SNM was given a lawful order not to consume alcohol by the Battalion Commander.
         Award: Forfeiture of $ 369.00 per month for 1 month, restriction and extra duty for 14 days. Not appealed.

040416 :  SJA review determined the case sufficient in law and fact.

040421 :  GCMCA, Commanding General, Marine Corps Base Hawaii , directed the Applicant 's discharge with a general (under honorable conditions) by reason of misconduct due to a pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20040422 by reason of misconduct due to a pattern of misconduct (A and B) with a service characterization of general (under honorable conditions). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The Applicant is requesting his characterization of discharge be changed to honorable. When a Marine’s service has been honest and faithful, it is appropriate to characterize that service under honorable conditions. Characterization of service as general (under honorable conditions) is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. The Applicant’s service was marred by the award of nonjudicial punishment (NJP) on 2 occasions for violations of the Uniform Code of Military Justice (UCMJ). The Applicant’s misconduct included assault, unlawfully choking another service member, and violation of UCMJ Article 92 (Willful failure to obey order, regulation). The Applicant’s conduct and proficiency markings, which form the primary basis for determining the character of his service, reflect his misconduct, and fall below that required for an honorable characterization of service. An upgrade to honorable would be inappropriate. Relief is therefore denied.

The Applicant claims he was diagnosed with a Bi Polar disorder before a pattern of misconduct was established. After a review of the record, it was discovered that a pattern of misconduct was established on 20020619. The Applicant was diagnosed by competent medical authority with Bi-Polar disorder on 20040108. The record of fact refutes the Applicant’s claim. Relief is therefore denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any additional evidence related to this discharge. Representation at a personal appearance hearing is recommended but not required.

Pertinent Regulation/Law (at time of discharge)

A. Paragraph 6210, MISCONDUCT , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16F), effective 01 Sep 2001 until Present.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article [e.g., 86, unauthorized absence for more than 30 days].
