Applicant ’s Request

The application for discharge review was received on 20060511 . The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable . The Applicant requests a documentary record discharge review. The Applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20070308 . After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant ’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain Under Other Than Honorable Conditions by reason of misconduct due to a pattern of misconduct.

The NDRB did note administrative error(s) on the original DD Form 214. Block 12a , Date Entered AD This Period , should read: 02 07 22 .” The Commandant, Headquarters USMC, Quantico, VA, will be notified, recommending the DD Form 214 be corrected or reissued, as appropriate.

030915:  Mental Health Evaluation
         In my opinion this service member has the mental capacity to understand and participate in the proceedings and was mentally responsible.
         AXIS I: Adjustment disorder with depressed mood.
         AXIS II: Personality disorder not otherwise specified with schizotypal features.
         AXIS III: None.
         Recommendations:
         SM’s condition and the problems presented by him do not appear amenable to hospitalization, treatment, transfer, disciplinary action, training, or reclassification to another type of duty within the military. He will likely continue to have significant problems while on active duty. It is unlikely that efforts to rehabilitate him or develop this Marine into a satisfactory member of the military will be successful. It is recommended that this Marine be administratively separated expeditiously
because this SM has a personality disorder that is so severe that his ability to function effectively in the military environment is significantly impaired and interferes with performance of duty.

The factual basis for this recommendation was two nonjudicial punish ments and summary court-martial . Applicant informed the least favorable character of service possible was as other than honorable.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20040115 by reason of misconduct due to a pattern of misconduct (A ) with a service characterization of under other than honorable conditions. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable ( B and C ).

The Applicant is requesting a discharge characterization upgrade to honorable. When a Marine’s service has been honest and faithful, it is appropriate to characterize that service under honorable conditions. Characterization of service as under other than honorable conditions is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. The Applicant’s service was marred by the award of nonjudicial punishment (NJP) on 2 occasions for violations of the Uniform Code of Military Justice (UCMJ) and one Summary Court-Martial hearing. The Applicant’s misconduct included unauthorized absence and Drunk on post. The Applicant’s conduct, which form the primary basis for determining the character of his service, reflect his misconduct, and fall below that required for an honorable characterization of service. An upgrade to honorable would be inappropriate. Relief is therefore denied.

The Applicant is claiming he had a mental disorder which manifested itself during his military service. The separation process was in strict compliance with the Marine Corps Separation Manual. For the edification of the Applicant, the mere presence of a personality disorder is not a bar to Naval Service. There is no evidence in the record to suggest that the Applicant was not responsible for his misconduct or that he should not be held accountable for his actions. In the Applicant’s case, the Board could discern no impropriety or inequity in the Applicant’s discharge based merely on the fact that Applicant was permitted to continue his service despite the presence of a diagnosed personality disorder. Therefore, the NDRB considered the Applicant’s discharge proper and equitable. Relief denied.

The Applicant is requesting an upgrade to receive health treatment from the department of Veterans Affairs. The Veterans Administration determines eligibility for post-service benefits, not the Naval Discharge Review Board. There is no requirement or law that grants recharacterization solely on the issue of obtaining Veterans' benefits and this issue does not serve to provide a foundation upon which the Board can grant relief. Additionally, the Board has no authority to upgrade a discharge for the sole purpose of enhancing employment or educational opportunities. Regulations limit the Board’s review to a determination of the propriety and equity of the discharge.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any additional evidence related to this discharge. Representation at a personal appearance hearing is recommended but not required.
