Applicant’s Request

The application for discharge review was received on 20050920. The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to general (under honorable conditions). The Applicant requests a documentary record discharge review. The Applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20060717. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain Under Other Than Honorable Conditions by reason of
misconduct due to a pattern of misconduct .

981113:  Commanding Officer, USS NIMITZ recommended discharge under other than honorable conditions by reason of misconduct due to commission of serious offense as evidenced by his violation of the UCMJ, Article 92, (2 specs) dereliction of duty by willfully reading unauthorized material while on watch on 980623 and disobeying a lawful order on 980812 by failing to go directly from the floating accommodation facility to Nimitz Bank Building and misconduct due to a pattern of misconduct as evidenced by two or more punishments under the UCMJ, in violation of an administrative counseling/warning page 13 within his current enlistment. Commanding Officer’s comments: “SNM has been given numerous opportunities. Despite these chances, he has repeatedly been an unauthorized absentee resulting in 3 NJP’s and 1 SCM. Furthermore, SNM is currently UA. SNM has no further potential for naval service. I strongly recommend that he be separated with a discharge characterized as other than honorable.”

981124:  GCMCA,
COMNAVAIRLANT NORFOLK, VA, directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to pattern of misconduct.

981124:  Applicant discharged in absentia (41days).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged in absentia on 19981124 by reason of misconduct due to a pattern of misconduct (A) with a service characterization of under other than honorable conditions. After a thorough review of the available records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (B and C). The Board presumed regularity in the conduct of governmental affairs (D).

In the absence of a complete summary of service, the Board presumed that, in accordance with Reference A, the Applicant violated a NAVPERS 1070/613 warning prior to processing. The Board also presumed that the Applicant was properly notified of separation proceedings and that he acknowledged his rights to be exercised or waived during separation proceedings. The Applicant bears the burden of overcoming this presumption of regularity by presenting any substantial and credible evidence. The Applicant did not provide any documentary evidence to challenge the propriety or equity of the discharge. Therefore, the Board considered the Applicant’s discharge proper and equitable. Relief not warranted.

The Applicant claims to have learned his lesson and therefore desires an upgrade to honorable. When a Sailor’s service has been honest and faithful, it is appropriate to characterize that service under honorable conditions. Characterization of service as under other than honorable conditions is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. There is irrefutable evidence that the Applicant’s conduct during his time in the service was not honorable. Indeed, the Applicant’s records contain:
•         Non-judicial punishment proceedings on 19970116 for violation of four specifications of UCMJ Article 86 (Unauthorized absence);
•         Non-judicial punishment proceedings on 19980513 for violation of UCMJ Article 86 (Unauthorized absence);
•         Non-judicial punishment proceedings on 19980806 for violation of four specifications of UCMJ Article 86 (Unauthorized absence) and Article 92 (Dereliction in performance of duty); and
•         Summary Court Martial conviction on 19980911 for violation of two specifications of UCMJ Article 86 (Unauthorized absence), Article 92 (Failure to obey order or regulation), and Article 134 (Breaking restriction).
The Applicant’s conduct, which forms the primary basis for determining the character of his service, falls well below that required for an upgrade in characterization of service. An upgrade would be inappropriate; therefore relief is denied.

The Applicant informs the Board that he is “trying to build a better future for [his] family.” There is no requirement or law that grants recharacterization solely on the issue of obtaining Veterans' benefits or enhancing employment and educational opportunities. Since these issues do not serve to provide a foundation upon which the Board can grant relief, relief on this basis is not warranted.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support post-service accomplishments or any other evidence related to the discharge at that time. Representation at a personal appearance hearing is recommended but not required.
