Applicant’s Request

The application for discharge review was received on 20041029. The Applicant requests the characterization of service received at the time of discharge be changed to general (under honorable conditions). The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.

In the acknowledgement letter the Applicant was informed that he was approaching the 15 year point for review by this Board and was encouraged to attend a personal appearance hearing in the Washington, DC area. The Applicant did not respond.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20050201. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – commission of a serious offense, authority: NAVMILPERSMAN, Article 3630600.

“I AM REQUESTING FOR AN UPGRADE OF MY DISCHARGE (OTHER THAN HONORABLE) CONDITIONS TO GENERAL/ UNDER HONORABLE CONDITIONS. IT HAS BEE 14 YEARS SINCE I HAVE BEEN DISCHARGED FORM THE MILITARY AND WITH ALL DUE RESPECT TO THE U.S. NAVY, MY COMRADS AND COMMADERS, I OFFER MY HUMBLE APOLOGY FOR COMMITTING A TERRIBLE, YET IRRESPONSIBLE ACT OF GOING AWOL IN 1991. I WAS YOUNG, INEXPERIENCED, AND CONFUSED WHEN I WAS NOTIFIED THAT MY MOTHER HAD PASSED AWAY, YOU ALLOWE ME TO ATTEND HER FUNERAL, BUT IT WAS SO DEVISTATING I FOUND IT HARD TO LEAVE BECAUSE I WAS SO AFRAID. PLEASE UNDERSTAND AND HONOR MY REQUEST TO UPGRADE MY DISCHARGE TO GET A JOB AND PROVIDE FOR MY FAMILY. PLEASE AND THANK YOU FOR YOUR KIND CONSIDERATION.”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19910918 under other than honorable conditions for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. While he may feel that his family problems, youth and immaturity were contributing factors, they do not mitigate the Applicant’s disobedience of the orders and directives that regulate good order and discipline in the naval service, demonstrating he was unsuitable for further service. His service record is marred by award of special court-martial for violating the UCMJ, Article 86 (UA for 119 days) thus substantiating the misconduct
. Unauthorized absence in excess of 30 days is considered a serious offense. The evidence of record does not demonstrate that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.

Pertinent Regulation/Law (at time of discharge)

A. Under the Manual for Courts-Martial, a punitive discharge is authorized for violation of the Uniform Code of Military Justice, Article 86, for unauthorized absence for a period in excess of 30 days if adjudged at a Special or General Court-Martial.
