Decision

A documentary discharge review was conducted in Washington, D.C. on 20050201. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN 6210.5.

1. “I think that my discharge was inequitable because I was discharged six months after I got in. I just began my military life. The reason why I want my discharge to be changed is so that I can get back into the military. I love the military and want to be and serve my country. I want to go and fight in Iraq. Please members of the Review Board take into consideration and change my discharge so that I’ll be able to serve my country.”

030131:  Initial enlistment contract documents admission of pre-service marijuana experimentation. Enlistment waiver granted. Applicant briefed upon and certified understanding of Marine Corps policy concerning illegal use of drugs.

031119:  NAVDRUGLAB [SAN DIEGO, CA], reported Applicant’s urine sample, received 031114, tested positive for [cocaine].

031125:  Counseled this date concerning my illegal drug involvement (cocaine) identified in his system through urinalysis confirmed by Navy Drug Lab SAN DIEGO, CA msg 191849ZNOV03. Necessary corrective actions explained. Sources of assistance identified. Disciplinary and administrative discharge warnings issued.

031201:  NJP for violation of UCMJ, Article 112a: Wrongful use of a controlled substance, to wit: cocaine: 109ng in his system; while attached to India Co, SOI(W) on or about 031111.
Awarded forfeiture of $575.00 pay per month for 2 months, restriction and extra duties for 45 days, reduction to E-1. Not appealed.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20040109 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The Applicant’s time in service does not provide a basis for relief. The Applicant’s positive urinalysis and nonjudicial punishment for cocaine use provides credible evidence in the record that the Applicant used illegal drugs. Drug abuse warranted processing for separation. Separation under these conditions generally results in characterization of service under other than honorable conditions. The discharge was proper and equitable. Relief denied.

The NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter.

The Applicant’s discharge characterization accurately reflects his service to his country.
Normally, to permit relief, an inequity or impropriety must have existed during the period of enlistment in question. No such inequity or impropriety is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received at the NDRB within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
