Applicant’s Request
The application for discharge review was received on 20040220. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20041001. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Applicant’s issues, as stated on the application:

1. “My discharge was inequitable because out of 3½ yrs I spent in the Navy, I never involved myself in any type of trouble or never thought about jeopardizing my career in the matter I was discharged for. I plead not guilty and spoke with legal personnel on board the U.S.S. George Washington for an examination on the drug test I was given. My paperwork was not being processed correctly by the legal office on board the ship for a Board. I checked in with Legal more than twice a week for information on my review. Five months after my reduction in rate and a week before the ship’s six month deployment, my paperwork was not processed and Legal then explained that I would not be allowed to go on the deployment. I checked out May 22, 2000 and could not get any information or documents that I signed regarding my review. I am innocent and only wish I had a fair chance to speak with authentic legal advisors about my examination. I will be content if my discharge was changed.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20000522 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The Applicant states his discharge was inequitable because out of 3½ yrs I spent in the Navy, I never involved myself in any type of trouble.” Despite a servicemember’s prior record of service, certain serious offenses, even though isolated, warrant separation from the naval service in order to maintain proper order and discipline. The Applicant’s service record is marred by award of nonjudicial punishment (NJP) for illegal drug use, thus substantiating the misconduct for which he was separated. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge. In the Applicant’s case, the Board could discern no impropriety or inequity and therefore consider his discharge proper and equitable. Relief denied.

There is credible evidence in the record that the Applicant used illegal drugs. Mandatory processing for separation is required for sailors who abuse illegal drugs. Separation under these conditions generally results in characterization of service under other than honorable conditions. The Applicant’s allegations, that he his paperwork was not processed correctly and that he was unable to examine the drug test he was given are not supported by the documents submitted by the applicant nor the evidence of record and do not refute the presumption of regularity in this case. There is no indication in the record that the Applicant appealed his nonjudicial punishment. The Applicant waived his right to consult with counsel on 27 April 2000 and also waived his right to request an Administrative Board. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
