Applicant’s Request

The application for discharge review, received 020906, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030612. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.



PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues, as submitted

1. I feel that I was, and can still be, an asset to the Navy. I don't think that I was given the chance to prove my Innocence.

My request for a Special Court Martial was denied. See attached documents.

2. To whom it may concern,

My name is O-- S. A---. I am requesting an upgrade of my discharge from the Navy. I do realize that my discharge was based on a drug related case, but I was never given the chance to prove my innocence. Attached is paperwork showing that I was in fact an asset to the Navy. I do admit that I made a bad choice by being around people while they were smoking marijuana, but like I've said from the beginning, I do not do drugs. I wanted to go to Court Martial to defend myself, but was never given the opportunity. Before my situation happened, I never knew that a request for Court Martial could be denied. I feel that my right to a fair trial was taken from me. All I am asking is to get my discharge upgraded so that I may be a respected part of my community, and maybe join the Naval reserves. I do appreciate your consideration.

010313:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

010501:  Applicant advised of rights and having consulted with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to submit statements. Applicant originally elected an administrative discharge board on 010315.

010509:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

010529:  Commander, Navy Region, Mid-Atlantic directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 010615 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issues 1 and 2. There is credible evidence in the record that the Applicant used illegal drugs. Despite the favorable references from members of his chain of command, drug abuse warranted processing for separation, normally under other than honorable conditions. The decision whether to refer a case to a court-martial or to impose non-judicial punishment is within the discretion of an individual’s commanding officer. Administrative separation regulations allow for the separation of an individual for an offense that constitutes a violation of the UCMJ without a finding of guilty at either a court-martial or non-judicial hearing. Accordingly, the fact that applicant’s commanding officer did not take disciplinary action prior to initiating administrative separation proceedings does not constitute an inequity or impropriety. Relief denied.

The Applicant’s discharge characterization accurately reflects his service to his country. The discharge was proper and equitable.
Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received at the NDRB within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
