Applicant’s Request
The application for discharge review was received on 20030502. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293. In the acknowledgement letter the Applicant was informed that he was approaching the 15 year point for review by this Board and was encouraged to attend a personal appearance hearing in the Washington, D. C. area. The Applicant did not respond.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20040401. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – Drug abuse, authority: NAVMILPERSMAN, Article 3630620.

“1. I believe that my discharge should be upgraded for the following reasons:

I completed almost 2 enlistments with good behavior and I was looking forward to a career in the Navy. In early 1988, my wife left me for another woman and took our children with her. The emotional stress was too much for me and I ended up hospitalized at NAS Jacksonville in a psychiatric ward. This stress was the main contributor to my behavior that caused my discharged. I feel that my behavior was wrong, but that it was under mitigating circumstances.”

880610:  NJP for violation of UCMJ, Article 86: (2 Specifications) UA, Spec 1: UA on or about 1230, 880416, Spec 2: UA 880427-880507 (10 days), violation of UCMJ, Article 108: Without authority, through neglect damage a military property of the United States, violation of UCMJ, Article 112a: Wrongful use of cocaine.
         Award: Reduction to E-3. No indication of appeal in the record.
880612:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by the wrongful use or possession of a controlled substance.
880612:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19880722 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. While he may feel that his marital problems were contributing factors, they do not mitigate the Applicant’s disobedience of the orders and directives that regulate good order and discipline in the naval service, demonstrating he was unsuitable for further service. His service record is marred by award of non-judicial punishment (NJP) for illegal drug use . Relief denied.
