Applicant’s Request

The application for discharge review, received 010307, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a personal appearance hearing discharge review before a traveling panel and a documentary record discharge review. The applicant listed a V.A National Service Officer as his representative on the DD Form 293. The Naval Discharge Review Board (NDRB) conducts a record review prior to any personal appearance hearing.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010907. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/ Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

Issues

1. I feel that my other than honorable should be upgraded due to the fact that upon release from active duty that I was not given a trial, because the simple fact of the matter is that I was not guilty of T.H.C. in my system. I don't and do not use drugs period. I am a big fan of the USN and would not pertake in any conduct that would dishonor my country or my selfs honors.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 880620 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue 1 states: “I feel that my other than honorable should be upgraded due to the fact that upon release from active duty that I was not given a trial, because the simple fact of the matter is that I was not guilty of T.H.C. in my system. I don't and do not use drugs period. I am a big fan of the USN and would not pertake in any conduct that would dishonor my country or my selfs honors.” The record shows that in addition to the applicant’s NJP for violation of UCMJ Article 112a (Wrongful Use of Controlled Substance), the applicant had two additional NJP’s for misconduct in his enlistment. All three NJP’s included serious offenses, where a punitive discharge may be awarded at a Court martial conviction. There was no impropriety in the fact that the applicant received NJP rather than a trial by court martial. The Board determined the applicant was afforded all his rights in accordance with the regulations and he elected to waive his rights to an administrative discharge board. The applicant established a pattern of misconduct that demonstrated he was unwilling to conform to military standards and was unfit for further service. Relief is denied.

The NDRB is authorized to consider post-service factors in the re characterization of a discharge. There is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant failed to provide documentary evidence to demonstrate his sobriety, positive community service, employment history, and clean police record. Relief is not warranted.

The applicant is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is recommended .
