Applicant’s Request
The application for discharge review was received on 20030324. The Applicant requests the characterization of service received at the time of discharge be changed to general/under honorable conditions. The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20040311. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

1. “2002/09/09
I respectfully request that my discharge be changed so I may use my G.I. Bill for college. I have come to the realism that smoking drugs gets me no where and I would like to reenlist. Concerning my record I might not have been the most squared away E-3 in the US. Navy, however my work was always done and I never got a report on my conduct.
2003/03/12
I do apologize for taking so long in sending my request. I did not feel as though the above is enough I have been out of the Navy for 27 mo. I have been employed for 11 mo. I have applied for numerous jobs and I can not receive them because of my record. I feel that I have learned my lesson. I have been drug free since Jan. 2001. I often reflect upon my service to my country and I’ve enjoyed every day I served. It was a great honor to serve my country and I have disgraced my country by performing my fool hearted act.”

000901:  Narrative Summary: Discharge Diagnoses: Axis I: Adjustment disorder with depressed mood, manifested by a recent exposure to a traumatic incident with symptoms of depression as well as a brief period of symptoms of intrusive thoughts and nightmares with the psychological disturbances rapidly moderating over time. Axis II: Diagnosis deferred due to the brief nature of the hospitalization.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20001207 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

 Issue 1: There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. At this time, the Applicant has not provided sufficient verifiable documentation of good character and conduct to mitigate his misconduct while on active duty. Relief denied.

The Board has no authority to upgrade a discharge for the sole purpose of enhancing employment or educational opportunities as requested in the issue. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge. In the Applicant’s case, the Board could discern no impropriety or inequity and therefore considered the Applicant’s discharge proper and equitable.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments or any other evidence related to the applicant’s discharge at that time. Representation at a personal appearance hearing is recommended but not required.
