Applicant’s Request

The application for discharge review was received on 20021118. The Applicant requests the characterization of service received at the time of discharge be changed to general/under honorable conditions. The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293. Subsequent to the application, the Applicant obtained representation by the American Legion.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20031229. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

3. I contributed many off-time hours with the community in providing security with a nieborhood watch association.”

981208:  BUPERS for departmental review recommending a second period of limited duty for 6 months to expire 990515.

990513:  Applicant self-referred for alcohol treatment. Has had no alcohol related incidents. He is motivated for treatment in past because his wife is threatening divorce if he doesn’t stop drinking. Last drink was 12MAY99.

990524:  Commenced Substance Abuse Rehabilitation treatment and completed treatment on 18JUN99.

990911:  NJP for violation of UCMJ, Article 86: Unauthorized absence from 0730, 990903 until 1130, 990907 (4 days/surrendered).

         Award: Forfeiture of $200 per month for 1 month, reduction to RM2. Punishment suspended for 6 months. No indication of appeal in the record.

991015:  Vacate suspended forfeiture and reduction awarded at Commanding Officer’s NJP dated 990911.

991202:  Fleet Mental Health Unit: Pt is at TPU awaiting admin separation. He has been UA, has failed drug test, and has history of alcohol dependence. Additional stressors are loss of income and being divorced by his wife.
Diagnostic Impression: Axis: Acute Stress Reaction. ETOH dependence by history. Substance abuse by history. Axis II: Personality disorder, NOS with antisocial features. Axis III: None known. Axis IV: Multiple severe stressors described above. Axis V: GAF 55-60 agitated, depressed, and anxious.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20000107 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The Applicant requests the Board consider the fact that he served “our country” with honorable service “for over 14 years”. An Under Other Than Honorable Conditions discharge is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. T he Applicant’s service was marred by the award of NJP on two occasions for two unauthorized absences totaling 26 days and use of illegal drugs. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Navy and falls far short of that required for an upgrade of his characterization of service. Relief on this basis is denied.

The NDRB noted an administrative error on the DD Form 214 issued on 20000107. Block 18 did not reflect the Applicant’s previous years (890222 – 980720) of honorable service. The Board notified the Commander, Naval Personnel Command, Millington, TN and recommended the DD Form 214 be corrected or reissued.

Issue 2.
The Applicant contends that prior to his discharge he was involved in a very harsh separation with his spouse. The Board acknowledges the personal challenges that the Applicant experienced with his family, however, the extensive counseling that the Applicant received to address family concerns is well documented. The evidence of record did not show that the Applicant was either not responsible for his conduct or that he should not be held accountable for his actions. Relief on this basis is denied.

Issues 3 and 4.
The Board is authorized to consider post-service factors in the recharacterization of a discharge. However, there is no law or regulation, which provides that an unfavorable discharge, may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, a procedural error or inequity must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, is considered. Examples of documentation that should be provided to the Board include proof of educational pursuits, a verifiable employment record, documentation of community service, certification of non-involvement with civil authorities and evidence of drug free existence. At this time, the Applicant has not provided any documentation for the Board to consider. Therefore, relief is not appropriate.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide such documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
