Applicant’s Request

The application for discharge review, received 001215, requested that the characterization of service on the discharge be changed to honorable and the reason for the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010601. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

Issues

1. I was married one year before my discharge to a lovely woman whom I thought I'd be with for life but circumstances didn't permit and after we made and agreement to divorce I was devastated and emotional disturbed. I had made attempts to voluntary separate from the Navy but wasn't allowed separation upon request. Reason for asking separation was to salvage my marriage. That's when I started getting involved w/marijuana heavily and eventually I tested positive for the use of it.

980108:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by member receiving NJP on 971216 for violation of UCMJ, Article 112a: Wrongful use of marijuana; and by reason of misconduct due to commission of a serious offense as evidenced by member receiving NJP on 960212 for violation of UCMJ, Article 92: Failure to obey a lawful order and; by reason of pattern of misconduct as evidenced by member receiving two NJP's during his current enlistment.


980114:  Commander, Amphibious Group TWO authorized the applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 980127 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue discussed the circumstances of his misconduct as matters of mitigation. He stated that he was in the process of a divorce and was denied his requests for voluntary separation. The applicant provided no documentation to support his issue, and the board found nothing in the applicant’s service record to support this issue. The NDRB found the discharge proper and equitable as issued. Relief based on this issue, relief is not warranted.

The NDRB is authorized to consider post-service factors in the re characterization of a discharge. There is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant failed to provide documentary evidence to demonstrate his sobriety, positive community service, employment history, and clean police record. Relief is not warranted.

The applicant is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is recommended.
